My 2 cents?  Keep the individual in solitary until they either withdraw the claim, or have the reassignment surgery so the parts match the claim.

That was my first thought when reading it (or hoping that he can overpower the guard's one the female side and escape)

But there seem to have been quite a few transgender people who join the military (maybe to prove themselves as being able to do macho things, or denial of their feminine side?) and there are also quite a few who commit crimes.  Could this because they don't feel like they're really a part of society, and thus it's more difficult for them to follow the rules of society when they know society's rules are there to deny that they're valid people and keep them miserable?

(I suspect that much of the 'black crime' is this, too.... When people realize that they're being sold lies about how you just have to work hard and pull yourself up, but they're knocked down when they're seen as 'uppity' for trying to actually do it)

Or maybe there's no correlation, and we just notice / remember people who are different from society's norms more, so it seems like there are a lot of trans criminals?   (Or they do a better job blending in than we give them credit, so there's a higher proportion of transgender people than we realize?)

I think this would be a useful thing to study.... But at the same time, suspect that trans people wouldn't want to be studied for this, as it would be twisted into 'trans people bad' by so-called conservatives

I think there was a Law and Order episode where some guy asked for the death penalty, and then his lawyer used that as a reason why he shouldn't be in jail at all, because you had to be insane to want to die

Huh? The choice is whether she dies in a women's prison or a men's prison. Calling it a "Sophie's choice" is more than a bit of a stretch.
