Her going public with the details of O'Reilly's alleged conduct has caused "significant irreparable harm" to the former Fox News star, the lawyers further argued.

That's preposterous. His reputation can't be any worse than it already is.

Non disclosure agreements should be illegal.

I can't believe we're still talking about this. Over/under on the number of times "falafel" is written in O'Reilly's obituary? (Answer: Not enough.)

OptionC: Non disclosure agreements should be illegal.

She was not forced to sign it.
She could have continued with her lawsuit or negotiated a different settlement.

If you make them illegal, then more of these cases will go to court. While that may not be a bad thing in some ways, settlements take cases out of the court system to make room for other things.

Strange, I thought the sexual harassment itself was responsible for that.

Just did a superquick google, one eye shut and the other squinting just to be safe, it appears he was sexually harassing someone about taking a shower together and used the word falafel when he probably meant loofah.

/It sounds like I made that up, doesn't it, you'll have to google to find out if I did

Maybe, Billo, you could try to not be such a creep to someone.  It's a lot less expensive, and much simpler.

He's was a middle-aged man at the time - not a beardless youth.  He should own his behavior.

Yeah I hear he really puts the baba in baba ganoush, if you get my meaning.

That reminds me that during this whole Pandemic I made no falafel even though I really meant to make some because I love them.

Well, I probably still have at least another year or two to straighten that out, thank god.

By removing her shirt and skirt, and by leaning back on the couch, she had signaled her desire. Now, she closed her eyes, concentrating on nothing but Shannon's tongue and lips. He gently teased her by licking the areas around her most sensitive erogenous zone. Then he slipped her panties down her legs and, within seconds, his tongue was inside her, moving rapidly.

I don't know how she gets around the NDA. But, does she really have to? All she has to do every few years is threaten to break it, and all of the details we've already heard are back in the news, waiting for a new cohort of readers to find out about them and gag. So we wind up with O'Reilly methodically and deliberately humiliated in an ongoing basis while she stays within the boundaries of the agreement and is allowed to retain the $9 million in hush money. Sounds like a win/win situation to me.

I don't understand how a "contract" that requires a person to remain silent about criminal activity can meet the test of being conscionable.

is there anything that old white dudes can do with impunity any more? I mean, people film you when you try to beat on those people. Women file lawsuits nowadays. Your kids will write books. The news will cover you putting your dog on the roof of a car even. Sheesh...what's the point in being a rich old white dude if you gotta navigate all this agita?

I don't see how it's anyone's business but her own if she breaches it anyway. How can there be a restraining order about a civil contract?

Obviously, IANAL

Nondisclosure agreements should be restricted to certain proprietary information. Sexual harassment should not be something that can be covered by an NDA.

It's my considered opinion that O'Reilly is a creep.

Sweet Jeebus, that's erotic!  He missed his calling and should have writ for a really classy magazine like Hustler or something!

His first book was actually a hilarious bit of fiction titled "Those Who Trespass" featuring a tough but vulnerable Irish lead named Tommy O'Malley and features some of the most hilarious/cringeworthy attempts at erotic prose you are likely to read. A character is referred to as 'Snorkel Man' at one point.

The book is really a transparent revenge fantasy for the author against people he despises. O'Reilly hates Michael Moore, hence a totally original character in his book named Martin Moore, introduced as a 'fat load'.

Doesn't this restraining order simply confirm that what she's saying is true?

Financial crimes are still a good gig for them. Being a traitor to your country seems to pay well.

Does Bill have a side gig going on at Literotica or something?  Because that is creepily specific.

Why does she need a talk show to get this out? Just grab your phone, record what you want to say and post it on social media.

I disagree, in some cases NDA's are appropriate. But my guess is she is going to outline illegal activities, which are not covered by NDA's.

If I were her I'd go through with it and dare O'Reilly to make a big deal out of it.

NDAs by law cannot cover illegal behavior, right? If your boss breaks the law, you're not barred from talking about that.

Unfortunately, right or wrong, sexual harassment is not a crime. It's a civil tort, but not a crime. We should be asking why that is.

Free speech.
The gov't* cannot stop you from saying "hey baby, nice tits" but your employer can.

(*exception, when the gov't IS your employer.)
