If I find something on my car that doesn't belong, it's getting thrown into a body of water. I have no idea what it is or who put it there, and that device is not my responsibility.

Do those trackers come with a sticker that says "property of your local police department"? If not how would I know? Greyhound it is.

Yeah, that is an easy way to get charged with theft or destruction of government property.  If you ever find one on your car, leave it there and call a lawyer

If the cops would quit putting them in the wheel wells of the cars they are trying to track it wouldn't be so easy to find the trackers. Seriously, find some new places to put them that won't be spotted in 5 seconds when someone goes to find one.

Detach it , put it under the wheel of a car parked adjacent to you.

As said there are two different types of tracking devices.
One records your travels and needs to be retrieved and the info downloaded (not a real time tracker)
The second is one with some type of radio communication, think cellular. And it can report location real time.

If you attach one of the first type to some outgoing vehicle, you can be charged with "stealing" govt property.
Law on the "live" trackers is a bit more murky.

The article actually quotes from a case where it was determined that citizens can't be charged with theft for failing to return the device, and by extension are not considered responsible for whatever happens to it once it's on their car.

Unless it's marked to indicate who it belongs to, it's abandoned property as far as the subject knows and can be dealt with accordingly.

I always thought I would ship it USPS ground to Barrow, Alaska. Address it to myself as "General Delivery - Hold for Pickup" with no return address.

2. If you don't know that it's government property, you can't be charged with destroying government property.

They did.  How dare you read the article!  An ongoing investigation after she admits she was busted on serious drug charges and they came to her because one of her friends has federal warrants.  My guess is they were hoping she would lead them to a bigger fish.  Absolutely terrible stealth installation by the cops, though

It'd be up to the cops to prove who "used" it.  There's no legal justification to assume that the person who owns the car is the one who removed it and put it some place else.

If I found a tracking device I would gleefully ship it to friends, who would gleefully ship it to other friends.  Hell, I'd even provide fresh batteries.

The possibilities would be endless.

Oh, wait.  Use a drone to drop it on top of the Chief's house.  Or a mosque to totally fark with the detectives.

IANAL--do citizens have a right to know if there are warrants active against them?  That is, would someone with one of these on their car be able to determine if it's there legally?
