The quoted statement is the only portion of the article that is relevant. He knowingly overstayed his Tourist Visa breaking immigration law. America does not have an 'official' open border policy.

You should keep reading because he elaborates that he was the victim of a scam while attempting to change his tourist visa to a work visa, spent time in a detention facility in 2012 before finally getting a temporary authorization after a hunger strike. He then started the process to turn that temporary authorization into a work visa.. It wasn't until 2019, after he worked on a movie called "The Infiltrators" about the hunger strike, that he was targeted for arrest and deportation.

I feel bad he was part of a scam, but you can't convert a tourist visa to a work visa once your tourist visa expires. That's a pretty standard policy across the world. I know this firsthand, because I was living in China and my tourist visa expired, so they threw my ass out.

Where China differed, however, is that I was allowed to get another tourist visa after I left. Since I had a company sponsor, THEN they let me convert it to a work visa. I doubt ICE is ever going to let this man back in the country, which is shiatty.

To be fair, we don't know if the visitors visa expired before he started the process with the lawyer who scammed him or after. The specifics of that case though do not necessarily reflect why after being in good standing with immigration officials after his 2012 release he would then become a target only after the release of his 2019 movie.

More generally though this is a data point in a broader trend of ICE and Customs & Boarder Control officials abusing their broad authority and the opaque nature of the immigration system to silence people critical of their efforts.

The other option is good old incompetence at ICE, where they either slow-walked or lost the paperwork. I've been involved as an advocate on a couple of cases like that.

Ok, one world government is illogical.  What is the correct number of governments?  Obviously not the current number, there are wars and borders and people being made illegal.  So it is either more or less than the current number.  Probably not more, though.  So, what, maybe 5 total national governments?  North america, south america, Africa, europe, and asia?

Immigration, to my knowledge, has never been under DOL.  When it was INS, and not ICE/USCIS/CBP, it was under the DOJ.  DOL is only responsible for issuing labor certificates for employers who claim that they cannot fill their jobs.

Enforcement was probably  a better fit under DOJ than DHS.  It was also better when Customs wasn't lumped in with the mission for immigration enforcement.  Bureaucratic Empires aren't going to build themselves, though.

So what is the objectively best number of countries.  Apparently one world government is wrong.  And 4 plus Asia is wrong.  So, 4 plus multiple Asian countries is the best?  6 countries?  China and Japan splitting the asia continent?

Well, how do we square immigration in the current north (and central) american countries?  If people are coming to america "illegally" through the southern border, it must be bad to have the southern border.  Or are the people wrong?  Which side is incorrect, the people who want a southern border or the people like me who want one world government and total equality?

That won't work, either. The Chinese also hate the Vietnamese, the Vietnamese hate the Chinese AND the Japanese, and no one likes the Filipinos.

So the objective best is a world with border and people not allowed to work and live wherever they want?

OK.  So, the current situation is objectively the best.  That must mean tiawan is objectively good being separate from China.  And the whole isreal situation is objectively better than a Palestinian state.

Are we sure a one world government isn't objectively best?  People can hate each other under the same government.  Just like right now in the US.  So, wouldn't a world with the same amount of hate but more freedom in movement be better?

Oh.  I see.  China, Israel and Palestine.  My phone capitalizes those if you spell them right the first time.  But if I spell Israel as "isreal" it changes it to "is real", and when I back space it to change it, it doesn't make it capitalized.

It's a little more complicated than that.  He and his family originally came to the US on a tourist visa.  They applied for T nonimmigrant status.  The lawyer that was "helping" them basically scammed them (according to Rojas).

How long Rojas knew that?  No clue.  In several of his articles, he blames Trump, but Rojas was first detained, incarcerated, and scheduled for deportation during the Obama administration.  He came to some kind of arrangement with ICE and had been reporting in to them, attempting to be granted a T-visa (issued for victims of human and labor trafficking).  There's currently a case against one of his employers for labor trafficking.

Fast forward about 8 years and change - Rojas does a film where he shows some sensitive material (whether it is or not, I have no real clue) regarding an ICE facility.  ICE is not a fan of that.  Rojas has been a pretty vocal immigrant rights activist for a while, but whatever he did for the film crossed the line (apparently).  So they arrested him for violating his current visa and scheduled him for deportation.

He had a hearing to fight the deportation order.  Federal judge (a Nixon appointee) didn't see it Rojas's way and basically punted the issue, dismissing the lawsuit by saying "well gee, ICE already deported you, so even if you had cause for a legal action (and we think that you do), there's nothing to be done about it since you're no longer in their custody."

Heck of a cop-out if you ask me.

Now we go to the US Court of Appeals - judges (a mix of appointees from Trump, Obama, Bush) have a veritable field day with ICE by pointing out that the deportation doesn't pass the smell test, and that this suspiciously looks like retribution for embarrassing them via the documentary.  They hopped on Rojas's lawyers as well, but seemed to be much more satisfied with his legal team's responses than with ICE's.  In the end, they made their opinion pretty clear that while they think ICE is not exactly behaving with the upmost faith, that they do not have the power to reverse the deportation.

We'll see if this goes any further (and I hope that it does).

/the article intrigued me, so I found a few more and read through the whole saga

It's rare that I don't have bad things to say about ICE but if I was living in a foreign land with iffy papers I'd probably go out of the way to NOT draw attention to myself, i.e. straight and narrow and don't make documentaries announcing my dubious status to the world.

AmbassadorBooze: Lsherm: AmbassadorBooze: North america, south america, Africa, europe, and asia?

Asians hate each other with a passionate intensity. That would never work. It's not JUST asians, but Jesus Christ ask a Chinese national about the Japanese sometime. You'll get a response that's probably more racist than a white Southerner talking about black people. In 1950.

So what is the objectively best number of countries.  Apparently one world government is wrong.  And 4 plus Asia is wrong.  So, 4 plus multiple Asian countries is the best?  6 countries?  China and Japan splitting the asia continent?

AmbassadorBooze: OK.  So, the current situation is objectively the best.  That must mean tiawan is objectively good being separate from China.  And the whole isreal situation is objectively better than a Palestinian state.

Less than 6% of Taiwanese want to reunite with China. So yes, it's objectively good for the Taiwanese.

Do you work hard at being this ignorant, or is it a natural talent?

Gordon Bennett: gar1013: jim32rr: Hopefully they grab up James Corden next.

Throw in John Oliver and I'll pay for the coach seats next to the loo.

John Oliver is a US citizen.

He can renounce, or we can denaturalize.

I agree taiwan should stay a country (unless we get 1 world government).  But if, I mean when, China makes a move and takes Taiwan, who the fark will stop them?  Nobody.  That's who.  So.  If Taiwan is not a country, and we no longer have the ideal number of countries (the current number), what is the next most ideal number?  Do we split up another country to get back to the ideal number, or do we go for one world government?

John Oliver apparently has duel citizenship.  The mother farker should choose a hole.  I have no respect for dual citizens.  I say the US should not recognize any dual citizens.  And deport anybody who says they are dual citizens.

fark people who can't choose a country.
