I seem to remember a few months ago the President directly involving himself in DOJ matters was a bad thing.

But seriously, it would not be a bad idea to get precedent on this, which means continuing the case.  If everything an elected official says in personal communications, even directed at specific private citizens can be considered to be acting in their official capacity, it basically grants them immunity from these suits, which is not good.
To drop it now might help E Jean Caroll, but to continue it and get a ruling against the DOJ might help her and a lot of people in the future.

Trump definitely pushed the boundaries on what is legal everywhere he could. They are going to have to end up codifying what those boundaries actually are now before someone else abuses them. The courts will have to do that.

You're a special sort of touched, aren't you?

Because you don't know what an executive order actually is.  It does not create some sort of extra-legislative law.  Congress does not write out laws that describe every little detail of every aspect of what they want to be done.  That would inevitably lead to having to write a new, superseding law when circumstances change even a little bit, and Congress spending it's time doing nothing but debating airport bathroom stall spacing.  Virtually every law passed has multiple places where the verbiage can be reduced to "Executive Agency X will do the needful".  It specifically cedes its authority to the executive branch - or part of the executive branch - to fill in all the details and change those details within some regulation-space.  This is called the normal ruck-and-run of government.

An executive order is just the President - as head of the Executive branch - telling his agencies how to interpret their authority given by Congress in a matter.  Now, there are many laws passed by Congress, and many executive agencies, so there ends up being many areas in which the President can issue an executive order.  And they have always been used.  George Washington issued the first one.  The Emancipation Proclamation was an executive order.  They are the tool the President uses to direct the federal agencies that are his responsibility.

They are not the President creating law by fiat from thin air as a dictator.  They were not created by Trump.  The big failing of executive orders is that Congress had long expected the President not to be a blithering idiot and so provided latitude for the President to make interpretations of law so he could do his job and they could do something besides endlessly pass milkfat regulations for yogurt.

What the DOJ is doing is waiting for the appeals court to rule on whether Trump was acting within the scope of his office when he said Carroll was too ugly to rape. See if you can wrap your head around why that might affect how the DOJ proceeds. Or go ahead and argue that waiting for an appeals court ruling is proof that we are in a dictatorship. You do you.
