This is symptomatic of larger problem on the left. They don't leave and don't allow others to be groomed as replacements. It's pure hubris because they will leave at some point and it may be a point at which everything they've stood for may be on the chopping block. Exhibit A: RBG

In my naive youth (Bush 43), I believed that SCOTUS was an institution above politics -- this belief was reinforced by moderate bipartisan support for Roberts (and even a hair for Alito) and overwhelming bipartisan rejection of Harriet Miers. Hell, even Blanche voted for Sotomayor.

But McConnell's bullshiat stunt with Garland has ruined any chance of SCOTUS being above partisanship. And truth be told, I don't want a partisan court. But here we are, so I'm all aboard for Breyer to retire ASAP.

I understanding the math of wanting him to retire. but basic human nature suggests you don't get to BE a supreme court justice if you're the type of person that gets nudged into retirement the first time Politico or a 2 term House Rep suggests that it would make their lives easier.

Now now, the exact same people who believe and espoused this in 2016 have now declared that nobody ever said or thought such a thing. Certainly not the very person who some weeks ago while biatching about Manchin (and by the way fark that guy) said that it would be better if he switched parties and gave the GOP control of the senate again because the backlash would somehow get progressives elected.

Obama and Biden both lobbied RBG to retire in 2010, believing that the GQP would retake the Senate, and fearing McConnell would rather see an 8-member court than dare allow the brown man pick her successor.

They were right.

For other examples, see Feinstein & Pelosi.  Both very power California Democrats who are more interested in keeping their seat than ensuring that the other party never gets it.  Their sin is pride, and it will damn us all.

I've always thought of the SCOTUS as pawns in a game of Three Dimensional Chess (actually Four Dimensional Checkers, time included).  Move them around, take some off the board, replace them with newer shinier pieces.

I'm sure the Justices think that way too.  They may place bets on how long a decision will stand after one, two, or three replacements.

It would be nice if they instituted a term limit on Supreme Court Justices.

Put it at something long, but not shockingly long, that way each court seat is still seen as an important political victory, but not something that will define an entire generation of legislation.  Maybe 12-16 years?  It would also mean that people would push for people with long resumes rather than long life expectancy.

And maybe to make the court's tone shift around a little by having the Justice with the most seniority be the Chief instead of it being appointed special.  Would allow for people with the most experience with the court to pick cases to erode or enforce past rulings rather than allowing a Chief Justice to create a much more robust legacy which makes for too much of single ideology at the helm.

And yeah, let's add more seats.  You can retort, "Why not 100 seats?  WhY nOT a MilLIon!?"  But let's be clear, the court does not have a great spectrum of legal perspectives or demographics.  2-4 more seats to provide a broader perspective would be appreciated.

There hasn't been a newly proposed amendment that has passed during my lifetime.  The last one passed in 1971.  I don't expect another one to be passed before my death, four or five decades from now.

/I'm not counting the 27th, since it was pending for 202 years before it was ratified
