It was used to support racist bullshiat yes, but it wasn't really a code word for it.  It was a general code word for the 'criminal type' which they quite happily included white people in.  White, but "Not our sort of person at all you know..." types.  Straight up "lesser" dog whistling, skin color wasn't the salient point.

Well, he appointed Thomas because he was replacing the courts first black judge, which surely made them throw out their first 20 choices.

It would have been nice if the author had included a description of what race norming in dementia testing is and how it functions.  Instead, it's just a rather perfunctory statement from counsel and no real details.  It's possible that differences can exist, certainly there are higher incidences of diseases among particular ethnicities, and apparently black people have higher incidences of dementia.  Hard to say what's going on here without more information.
