January 6 insurrectionist served with civil rights lawsuit --- at Mar-a-Lago. Yes, him.

The "tilting at windmills" lawsuit.

2021-03-03 10:19:23 PM
"The suit names Trump alongside his attorney Rudy Giuliani and the right-wing extremist groups the Proud Boys and the Oath Keepers as co-defendants and builds off the 1871 'Ku Klux Klan Act,'which was 'intended to protect against conspiracies, through violence and intimidation, that sought to prevent Members of Congress from discharging their official duties' "

Sounds about right.

Okay, who had the NAACP in their pool as the first to serve him? That was a little out of leftfield. I figured it woulda been E Jean Carroll or Melania with divorce papers to serve him first. The DOJ is going to take awhile and it sounds like the Manhattan DA is busy trying to flip Allen Weisselberg, so they'll be awhile too.

Still would have liked to see a Senate or House summons or two. There are so many things to subpoena him for.

The civil part plus the seditionista defenses should be entertaining.

What took so long, did the lawyer's assistant have to deliver it by foot, directly from their hand to his?

It would be funny if they get a bunch of the property Trump is trying to sell, as payment, or better yet, Trump get's blocked from selling it, for the time being, because of a lean.

No, because a) he'll grift a bunch of money from the rubes to foot the bill, which b) he won't pay anyway.

/ Past and prologue and all that

What's funny is the Orange Traitor has done such a wonderful job of burning any lawyer that has represented him that he's going to have a hard time finding competent representation. If his representation is incompetent, he can lose even if the case against him is weak, especially since the bar in a civil case is lower than in a criminal case.

Do mistrials apply to civil suits?

Thanks to your wonderfully lax campaign finance laws (for freedom) probably not.

Yeah, but there' s no double-jeopardy.

Ah, so he can still get a mistrial for incompetent representation. Probably again and again and again for the next decade or until he dies.

The best I can find on civil jury trials is the following. It sounds like it still takes a unanimous decision (so it sounds like a mistrial is possible) but the bar for guilt is lower (so it should be easier to get a unanimous decision). Maybe this varies by locality. But I am nowhere near even an internet authority on this, having obtained my JD from a Crackerjack box.

Civil trial: Litigants seek remedies for private wrongs that don't necessarily have a broader social impact. At least six people make up a civil jury. The jury must come to a unanimous decision unless specified otherwise. The standard of proof is a "preponderance of the evidence," or "more true than not."

Even better:

In Florida (in most cases) you cannot lose your house in a lawsuit; your home is protected from creditors and there is no monetary limit on the this exemption (although I think there is an acreage limit).

Great part is, despite the fact that Trump lists Mar-a-lago as his residence, I'm pretty sure it is still zoned commercial....

tRump should be called out for never doing his job, sure he claimed not to take a wage, but that doesn't mean he should not have been working and doing the job of being The President of the USoA.

tRump never worked a day in his life and his term as president displays this in total recorded history.

Is there a crime about about being a fake president like there is for being a fake cop?

tRump also pretends to be a billionaire, via accounting manipulation that will soon come to light.
