You can plead the Fifth in a criminal trial and your failure to answer CANNOT be used against your case (if fact, if the prosecutor knows that you will be pleading the Fifth they cannot put your on the stand just to make you do it in front of the jury to prejudice them against you since your refusal to answer cannot be held against you).

While you can plead the Fifth in a Civil trial, your refusal to answer CAN be held against tour case in the civil trial.

So either incriminate yourself (and probably lose) or refuse to answer and definitely lose.

/couldn't have happened to a nicer guy.

What you are saying is not all the way true. The judge will absolutely make the declarent invoke every time no matter what. They will just have them go on record outside the presence of the jury. In some cases where some stuff is fair game still and not subject to the 5th the declarent must still answer in the presence of the jury and invoke if the prosecution trys to open the door. You are correct though. Mostly.

What's really going to happen to this poor fool is that he will forget what he lied about at his civil trial when the same question comes up in the criminal one, and vice versa. Meanwhile, I have no doubt the prosecutors have someone in the back of each courtroom taking notes in shorthand so they can find the exact question in the transcripts later.


"So, Mr. Wohl, you said that you DIDN'T robocall [insert location here] during your sworn testimony in Civil Trial Case No. XY-123; now you're saying you DID here today. Which one is the correct testimony, sir?"
