If the landlord is out of state, commerce clause is in play I would think. If not this judge may be correct. Since so many larger rental properties are owned by conglomerates and hedge funds this is definitely worth exploring.

If not this judge may be correct. the ICC is still in play because by renting from an in-state landlord the tenants are denying business to out-of-state landlords and that is the reason the Supreme Court has ruled time and time again that the act of not engaging in interstate commerce is itself an act of interstate commerce.

As much as it hurts me to say it, this was the right call. Unless the government wants to pay for the mortgages, upkeep, maintenance, insurance, and taxes of those properties, renters can get fukt.

Landlords are still expected to fund those police departments, fire departments, schools, libraries, and garbage pick up but can't collect from their deadbeat renters?

Nah. Either make the landlords whole or allow them the steps necessary to get paying renters in the building.

There are too many states that are like Texas for Texas to get its own "Jingoistic billionaire-humping hicks" tag. Oklahoma and Wyoming are also pretty Texas. Some states are even more Texas than that - think Mississippi, which seems to only exist to make Alabama look good.

The redstate race to the bottom is hardly at the halfway point so far. First state to not only legalize shooting minorities for sport, but suggest it as a pay-per-view in lieu of increased taxation, is the winner. ...So to speak.

Cool. I think the judge should be dragged from his home and be forced to watch as it's burned to the ground, and then have it explained to him that it's not an economic activity.

Fact is the commerce clause interpretation is obviously too broad but 1) applying it only when some person involved is in another state would be annoying and weird and 2) it's one of those things that's been stretched to let us have a modern developed-world economy because our political system is too broken to change fundamental parts of our laws that are all farked up (including the bits that cause our political system to be so broken).

So, you want to reward terrorists by giving them what they want?  I've never seen someone lose at 0-dimensional chess - until now.

If these farkers want to leave, they are welcome to pick a direction and walk/swim until they are off of US land and/or outside US territorial waters.  And they can take any inanimate objects they own and can carry with them.  But they don't get a single Planck length of American soil, nor infrastructure.  Quit enabling anti-American scum with your stupidity.

The eviction moratorium should be allowed to continue.  The logic used by the judge makes zero sense since it acknowledges legitimate reasons behind the order, reasons that fall under the constitutional powers of government, yet he uses that as reason to cancel it.

That said, help for the landlords is necessary too.  Arizona had a grant to resolve this issue, but they only gave it $5M in funding to the end of 2020.  A better funded programme with a similar set up would resolve a lot of the financial protests that landlords have with the eviction moratorium.
