If the presence of the 'warrior gene' could be used as a valid defense for murder, it would also act as a valid reason, public safety, to genetically test all men, and forcibly segregate those who possessed it.  Penalizing those who are actually man enough to control their damned temper.

I think it's funny that he believes court testimony saying he is "predisposed to impulsive acts of violence" woudl somehow have convinced the jury that he deserved a lower sentence.  If I'm on the jury, and the defense is making that argument, I'm going to want to throw the book at the guy.

Agrred.  Here, though, looks like he a)didn't get to make the argument at trial,  and b) the jury didn't find him guilty of premeditated murder anyway.  He's in for 2d degree.

Most appeals are long shots...this one was even more so.

Curious if there was any legit science they tried to use...it's obviously not mainstream thought...

That's essentially what the "Not guilty by reason of insanity" plea is. I don't know why people think the courts would just say "Whelp, sounds like you're a madman, you're free to go." Those funny farms were worse, plenty of people entered and never left their doors again. Its use declined sharply when sanitariums were shuttered in the 70's and 80's, but you can still end up in a prison psych ward or mental hospital for life if you're judged incapable of not harming others.

I mean, that's the obvious next step. If this gene predisposes someone to randomly commit murder, AND it is readily observable via genetic testing, then for public safety reasons we would be totally justified in testing all males--certainly all males who have committed any crime against the person at any stage of life--and preemptively locking them away.

And before anyone says "well, you can't judge someone guilty before they commit a crime," this line of defense is basically saying that guilt is irrelevant--these "warrior gene" folks simply cannot help being violent, and there's no way to know what will set them off, so we cannot wait till they snap before we lock them up. It's no different than locking up child molesters when we catch them trying to molest kids--we can't wait till they do it, because that would be wrong.

I think that's one of my airbrush works from the late '80s. Paasche VL3 dual action airbrush using acrylic paints and pressed with a heat iron to keep the colors from fading. I used 60 psi to push the paint through the fabric so it'll last longer. I painted a ton of those. Or the '80s is coming back in an ugly way.

I saw the Warriors for the first time last year. Until I watched it, I had assumed the movie was set in a post-apocalyptic wasteland. I guess NY in the 70's was pre-apocalyptic wasteland.
