A shame Democrats don't have dedicated investigators to deploy every time one of these Trump judges raises his head.

They weren't vetted by anybody but the Federalist Society and that was strictly ideological.

I certainly don't advocate manufacturing scandal, but somebody needs to look under some rocks.

Sounds to me that Joe Biden can make all kinds of agreements with states that bind federal agencies.

"Sorry, Texas, you don't get to lobby for lower emission standards for trucks. I made an agreement between the EPA and Connecticut banning the use of diesel engines in all class 3 and under vehicles in the name of fighting climate change. Judge Sh**head will back me up."

From 2002 to 2008, he was a member of the Republican National Lawyers Association. Since 2003, he has been a member of the Marine Corps Association. Since 2010, he has been a member of the Federalist Society. He has been a member of the Second Baptist Church in Houston, Texas since 2008.

Do you really need to know any other reason why he enjoined this EO?

You know, Biden is sitting on a boatload of Texas disaster relief money.  He could send it to Texas, but first, he might want to ask them to "do me a favor."  I believe that's now precedent as okay and fine.

I haven't read this case, but it's the same as Trump revoking DACA. The Administrative Procedure Act governs certain executive actions - it's meant to police actions by federal agencies. In Motor Vehicles Assoc. v. State Farm, SCOTUS ruled that removal of an administrative rule requires the same procedure as implementing a rule. The question here, I would guess, is whether the deportation moratorium is a rule or not. I don't know how the moratorium operates, but DHS has a lot of discretion when it comes to deportations. There's also a backdoor in the APA for emergency actions, so it's possible the judge is just being an ignorant dick.

The absurdity of this is that it was only supposed to be a 3 month halt to deportations until Biden could get staff and processes in place to stop things like the forced sterilizations that were taking place under Trump.

It was completely nonsensical to challenge it in the first place, and this judge being so ignorant of the law that he agreed with Texas is not a good sign of what's to come for any legal policies the Democrats manage to get past Manchin's and Sinema's efforts to cockblock everything.

You don't seek standing, you either have it or you dont. It's up to the defendant to challenge a plaintiff's lack of standing. As to your other point, Texans voted for the AG, so the AG represents Texas's interests in court.

It would be a neat trick if Biden could also make his executive orders and policies permanent simply by signing agreements with the states about them. Somehow I don't think this reasoning will hold up, though.

The Democrats have a majority in both houses of Congress; they can make Biden's policies irrevocable by a future President by just passing them as legislation.
