Listened to this weeks This American Life. The last story is about the Trump supporting immigration officer who is found out to be an illegal, and promptly fired. Oh and because of draconian Trump administration immigration policies can't get a green card even though he's married to an American.

Really sad story that I farking laughed my ass off at, because of stories like this.

The 9 yo was on a tourist visa and had previously enrolled in elementary school which is a violation of the visa. Still fuct up but the headline makes it sound like his was doing no "wrong". Of course instead of detaining him alone, a couple of questions could have been asked and a rapid approval method of fixing the visa to account for older adult brother being in college and on a valid student visa. Somehow this doesn't seem like the 9 yo was here to steal my job and was probably an honest mistake by older brother or parents not understanding the younger child also required a student visa if there is such a thing for a 4th grader.

Student visas are valid 6months -2 years.   Tourist and temporary visas usually are 30/60/90 days.  Long term visas such as student visas or various work visas are not that short.  The average is 1 year.

Here you go.  They didn't even get to enter the USA on there valid visa. Much less an opportunity to stay for the term and renew them.

Perhaps the only mercy here is that nine-year-olds generally don't know WTF is going on in any case, and are still highly adaptable, whereas someone in his late teens would be rightly terrified in this situation.

This is not a silver lining; it's little more than a faux-gilt lining, peeling off here and there, exposing the lead beneath.

The story, as it was relayed to me by my hopping mad cousin the immigration lawyer, is that upon arrival the elder brother's visa was removed by the immigration officers. Who promptly determined the younger brother, now traveling in the care of a visa-less person, was at risk under the terms of the act that purports to prevent violence to and trafficking of minors. The mother, basically going insane on the other end of a phone, begged the authorities to just let them both return but no, we are a nation of laws not men and the holy process had already begun. So the younger one was shipped off to a facility and Texas and I sort of lost the thread around there. My cousin is the cool and collected one in our generation of Klezzes - why she's an attorney and not some adrenaline-addict photographer - and I have never, not once, heard her so spitting mad. Thought my phone was gonna melt.

You're confused between the two different brothers. Older brother entered on an F-1 student visa and the younger brother entered on a valid tourist visa. They (CBP) likely turned them (two brothers) away for fear of filing a asylum declaration after entry as the Asylum Office in SF.

9 year olds have the ability to be totally freaked out at being separated from their families, but don't have the ability to truly understand what's going on like older teens, especially if it isn't properly explained to them, which I doubt they will bother doing.  The chances are far greater that this will fark up the young kid than the teen.  I mean, he's being put in what amounts to a group home and likely has no idea if he'll ever see his family again.

I was put in a group home -two, in fact- from the ages of 14~16, and I'm quite certain it would have been less traumatic had I been nine.

For example, I would probably have not understood why my fellow resident, Billy-Joe (I swear, that was his name) was transferred away after it had been discovered that he had sodomised the home's dog.

well, this article says the 9 year old is currently at a "government-run shelter for unaccompanied minors in San Diego". a different article i read said the plan was to then send him to an "unaccompanied minor center" in TX to await deportation, you know, these happy places:
