(ABC News)   Remember how we used to joke that if Trump was arrested for jaywalking, Giuliani could plead it down to murder 1? This isn't quite that, but in response to claims Trump incited the Beer Gut Putsch, Rudy describes "incitement" as exactly what happened   (abcnews.go.com) divider line

The former New York City mayor said that in his defense of the president, he would introduce allegations of widespread voter fraud that have been raised -- and rejected -- in dozens of courtrooms across the country.

The man is an idiot. Hopefully he won't be disbarred before he can help convict trump.

We would say to the court, 'You are now permitting in the future, basically in two days, the Congress can just impeach on anything they want to.

Maybe Giuliani is not familiar with what the Court has said about impeachment in the past.

"I'd much rather have my civil life complicated than my criminal life."

I wish it wasn't true, but there is no realistic chance that Trump will ever spend a day in jail. However, he is facing massive civil liability from multiple cases. Rudy is now working to maximize that exposure through his incompetence.

Rudy is worth every dime that Trump isn't paying him.

Move to dismiss?  Say to the court?

It's not a good sign for Trump when his impeachment lawyer is talking about an impeachment trial in the Senate like he's preparing for a civil trial in a federal courthouse.

"Well, if you can prove that it's true, or at least true enough so it's a legitimate viewpoint, then they are no longer fighting words."

"They basically claimed that anytime [Trump] says voter fraud, voter fraud -- or I do, or anybody else -- we're inciting to violence;

Lying fscking liar that lies, that is not the claim. The claim is saying things like "We are going to march down there!" "You must be strong, we can not take this country back without being strong" and "It is time for trial by combat!" incited violence.

Because it literally did.

That is some master class spin. If you were a teenager.

I don't think he's an idiot. You don't successfully prosecute major Mafia cases by being an idiot.

He is simply a moral vulture, a bought-and-paid-for prostitute, a truly horrible person who is willing to do and say the things he does.

Rudy got fired from his law firm a few years ago when he started this Trump journey.  Then his only other clients got arrested at the airport a year ago when they were trying to flee the country.  Trump is all he's got left.

Wait until he finds out that the Senate can set any rules they want. They don't have to hear witnesses, no one has to provide evidence, and they don't have to listen to anything from the person being impeached.

The Majority Leader could literally call the session to order, then immediately move to vote on the guilt of the impeached person.

And there's no appeal. I have a feeling Trump thinks an appeal to "his" Supreme Court is an ace up his sleeve. But it's a joker and he's at an Arby's, not at a poker game.

We need some witnesses. Like the Kraken. No, not the votie one. The real one. Let's do it.

I would suggest the courthouse from the Andy Griffith show but it's gone.

I have been in a bit of a rabbit hole today with videos of forty acres back lot. Andy, ST, GWTW, Hogans Heroes, Batman, Untouchables, a shiatload more. It was used from 1915 and wiped out in 76.

Tara was taken apart and shipped to Atlanta. The doorway is at the historical society. Why did they want this so much?

The best defense for Trump would be for his lawyers to argue that no real court would be able to convict because his statements to the crowd would never be considered incitement.  The statements were protected free speech (it was).  And then back that up with there was no investigation nor evidence entered past his statements.

and that he's prepared to argue that the president's claims of widespread voter fraud did not constitute incitement to violence because the widely-debunked claims are true.

That's his line of defence? Why could all these great lawyers not once in 60+ trials convince someone outside the cult of gullibles who are so brainwashed that they believe politicians feast on babies and trump is a good president for anyone beyond himself?

FTFA: "Well, if you can prove that it's true, or at least true enough so it's a legitimate viewpoint, then they are no longer fighting words."

The most persuasive arguments I've seen against the specific impeachment charge have been have been that criminal courts regularly dismiss or find innocent people who have said far worse things, because incitement requires a very specific action.

This argument is conceding that the words used were "Fighting Words" - which is a category of speech that is deemed so strong that imminent violence is universally expected.  Then it's trying to pull back and say 'but everything Trump said is fact, so the words and violence were justified.'

On top of this, he's going to be arguing this in front of a group of people who voted 92-7 against the challenge to Pennsylvania.  If this is their main argument, to be successful he has to convince ~28 senators that they were wrong to certify the vote.  I'm guessing Trump literally cannot find anyone else to take his case.

/Georgia's senatorial election actually makes it 27, because one of the Republican holder's term had expired.
//The other one who lost their race voted in the majority against the challenge.
