By now you know it doesn't farking work like that, and the more of them who get infected the more we are ALL at risk, since they're also out at the same stores and are delivering our food and working in our government offices and are in our classrooms and on and on and on.

Umm... The right to happiness is literally the right to be happy.

Places like Canada have the right to Peace, Order, and Good Government, POGG, because our founders realized the USA's right to the Pursuit of Happiness left big huge gaps that meant short term thrills at the expense of the long term interests that good government ensures.

Seriously, if you did some comaprative law, you'd see that much of the common law world decided the USA chose the "right to party woo Franklin loves his ether bongs" over the right to be protected from a plague. We foresaw this flaw and legislated against it in our constitutions.

You're precisely correct, the phrase "the right of the people peaceably to assemble" never occurs in the constitution or its amendments, and the courts have never once decided anything ever regarding it.

This is brand new legal territory that's been unexplored, until now.

Pure revisionist history on their part and I'm surprised that so many people buy it. That entire album was filled with the same sort of material. Chasing girls, doing drugs getting drunk, being rambunctious, etc. Almost every single song was focused on the same sort of stuff that was in that song, and so was some of their pre-rap stuff.

They grew up. That + a backlash against a song that got bigger than them, ala Radiohead and "Creep," and they began to peddle the "parody" story.

The song is 100% in keeping with the tone of that entire ALBUM, from Brass Monkey to Girls, Rhymin & Stealin, Paul Revere, No Sleep Till Brooklyn, and others.

They turned their back on that image, and that's cool. Like I said, they grew up. But I've never bought their revisionist history about the song for a moment.

2020-12-04 1:13:40 PM
So the "right to party" is contained within the First's guarantee of association (and, though she doesn't say it outright and instead cites OTHER cases which DO say it, expression); but since the Constitution doesn't explicitly say "privacy", that right doesn't exist.

Man, conservatives are weird.

If we had separate medical facilities for anti-maskers, and if those were staffed by anti-mask medical professionals, and if we could get them all to wear maga hats all the time so we know who they are, then I would whole heartedly support their right to party.

Unfortunately it doesn't matter how satisfying the irony is, the reality is that when these people get sick they will use up medical resources the same as someone who took every precaution and was forced to work. They will use up supplies, get medical professionals sick, soak up unemployment benefits that have been strained by the GOP's addiction to brinksmanship negotiations, and biatch about not being allowed to cough on cancer patients the whole damn time.

At this point not wearing a mask (or having it under your nose or under your chin) is a clear cut sign of a predilection for risky behavior (does not apply to people at work who have to wear masks all day and are 6 feet away from people and just need a little relief). More and more the spread is moving from those who were forced to put themselves in danger (expendable workers and their communities), to those who choose to put themselves in danger for political reasons. So you have the riskiest people being risky with each other as the virus is spreading through. Combined with the now casual and routine breaking of quarantine by those who have tested positive as well as the widespread and active avoidance of getting tested AND the climbing positivity rate, you have to assume that anyone not wearing a mask is not just an idiot taking unnecessary risks for everyone around them, but is an active threat that is knowingly or unknowingly contagious.

Six feet is the best we can do with our civilization and the presumption that the person standing 6 feet away from you COULD be positive but likely isn't. Six feet is not nearly enough for these plague rats.

I saw them at Lollapalooza in 1994.  They had the best set next to George Clinton's All-Stars but hey it's George Clinton.  But yeah there's no shortage of late 80's footage of them getting loaded, destroying hotel rooms, and taking groupies backstage.  They were in their 20's and living the life.  No use denying it.

None of this rebellion carries any risk.  The exercise of this "rebellion" confers no benefits on anyone.  It's just a low-risk, low-effort show.  It's a peacock strutting around with no one to see it.

Having been to one, they are a blackhole from which time, joy, and any semblance of a good time cannot escape. No one is happy to be there except to show other people that they showed up and network themselves, selling favors and jobs they can't deliver on and asking for same.

If someone looks happy to be there its because they're wearing their "actual human" mask. It has about a 5 minute lifespan before it has to be recharged for 30 minutes so limit your small talk to about that time frame.

If alcohol is being served, pacing is also very important. You will feel the need to consume as much intoxicant as possible as quickly as possible to numb the soul crushing disgust and dread that someone actually gave these people at least a modicum of authority, or in addition or the alternative that whatever these things are passes as human in some circles. The latter in turn may also bring on powerful bouts of ennui further encouraging the consumption of whatever free or even paid booze may be at hand.

DO NOT GET DRUNK. THIS MAY CAUSE ONE TO ACTUALLY TELL THE TRUTH IN THEIR PRESENCE WHICH THEY WILL FIND INCREDIBLY OFFENSIVE.

If you feel yourself becoming intoxicated, make a polite exit, and hail an Uber for the nearest bar or tavern. DO NOT GO HOME AND DRINK ALONE. You will end up drunk posting to facebook and things will deteriorate from there. You need people around you at this point. You need to have a break up with heavy load of negative emotions have attached themselves to you like oil to a duck after the Exxon Valdez and just like breaking up with real people, its better to do that in public where you won't make a scene and everyone can at least be initially polite about the whole thing.

I'm sure Ben also thinks that the song 'Girls' is about Women's Rights and the Equal Rights Amendment.

OptionC: The Federalist Society is a group of conservative lawyers that have been recommending judges to the GOP.

The Federalist is a MAGA-loon publication run by Ben Shapiro.

They are very different entities.

The Federalist Society hung a thin plexiglass barrier to separate themselves from The Federalist.

How can you nazi the Nazis are tots different?

Minor correction since apparently this has been at issue. It was a Federalist Society party not a party for the Federalist, and no OptionC, they are not distinctly different entities.  The Federalist Society cant tell the difference between their own rag and Shapiro's nether should you.

Glorious Golden Ass: ViolentEastCoastCity: Fart_Machine: Alphax: The Beastie Boys wrote that song to make fun of immature party animals.. not because they were immature party animals.

At the time they wrote it, yes they were immature party animals,

They were specifically making fun of KISS.

However, if someone asked me if I wanted to time-travel back to that time and party with the Beasties, of course I'm saying hells yes.

Because of the KISS army?

I think just their general over-the-top party image.

Different entities both with the same ideology, and influence working in both directions so... true, but not really all that meaningful.

Rapmaster2000: I've finally come up with a term that explains why these guys annoy me so much:  rebellious mediocrity.  "I'm sticking it to the man by having a party in a pandemic!"  "I'm sticking it to the man by not recycling like everyone else!"  "I'm sticking it to the man by driving this big, dumb truck I can barely afford instead of something normal!"

None of this rebellion carries any risk.  The exercise of this "rebellion" confers no benefits on anyone.  It's just a low-risk, low-effort show.  It's a peacock strutting around with no one to see it.

aka slacktivism.  but spiteful slacktivism

At some point, someone (hopefully adult, white male) is going to stand their ground against one of these plague rats and we'll really get a chance to see the conservative justice system stress the fark out.

JerseyTim: The right to party does not come from the Constitution. It is an inherent right of all.

You are of course correct, however the constitution does arguably protect your right to party as covered by the 9th amendment.

If everyone there is attempting to date rape each other, does it still constitute as rape?

That's odd. When I was in law school those federalist society guys were the least fun at parties.

Welllll...at the time it was released on License To Ill they very much were selfish obnoxious party animals.

They grew out of it fairly quickly though

I appreciate their sentiment, but without offering up an alternative solution that they feel is respectful of those rights, they really aren't helping anyone.

Exile On Beale Street: ArkPanda: Don't forget their affirmation of the Second Amendment in songs like "Paul Revere".

Somebody recently tried to accuse AdRock of being a misogynist b/c of that  song. I was like "Kathleen Farking Hannah married him. I'm pretty sure he's cool."

I just thought that made him a masochist atoning for his time as a misogynist.

Unfortunately, their go-to move now is to make everything worse so they can blame Biden for all of Trump's fark-ups. This doesn't just apply to the pandemic, it also includes the tax cuts expiring, debt going up, and other things that Trump really screwed up but which they believe they can make worse just through momentum. Then they can crank up the noise machine and complain about how much worse things are under Biden than they were under Trump and you should really elect more Republicans in 2022.

You know--standard Republican assholery.

It would be nice if we could elevate our discourse beyond, "The government can't MAKE ME act like an adult!"

But here we are.

2020-12-04 2:53:47 PM
"Unconstitutional" has become politically synonymous with "thing I don't like."

I really, really don't like that in a time of war our government can press me into service in the nation's military. It's a gross subjugation and loss of rights that could well get me hurt or killed. Yet I'd never argue that it wasn't constitutional because it is.

Instituting restrictions, closures, and lockdowns in a public health emergency such as this pandemic is exactly like that. It is a situation where a government's power is at its apex, not its nadir, and its powers to move to protect public welfare are historically both potent and broad. We actually have a long and varied legal history in public health buttressing that.

I was gonna say. There were stories from their first show in Seattle at Skoochie's (in the shadow of the Space Needle!), some of which they told themselves in their first interview in Spin, that match all but the very best Keith Moon stories.
