In a week when we see the smoke finally dissipating from the top of the wall and the fires have gone out, we can just pave over the corpses and crater they left fighting each other over whose more free and we build a massive ashamed emoji monument with a simple plaque that says "we are sorry rest of the world...  we fixed it now. Please let us play again"


And to get in, they'll have to make a pilgrimage on foot to prove their faith is real. We'll call it the Trail of Tards.

Nope. You and I agree that they should be closed. Like I say, I hate that they're open. I want them to close. I believe they should close. I'm appalled that they want to open. The right thing for them to do is close. But the letter of the law doesn't support what's right, in this case.

To say that differently, it's the law that sucks, not the court's determination.

There are three or four cases I can think of historically where that happened in a big way. Plessy vs. Ferguson was correct under the law, but absolutely shiatty for humanity. Brown vs. Board of Education was the opposite. The Jurisprudence was questionable at best, but came to the conclusion that was Right. Law is messy and the founders hadn't intended for this outcome. What's correct isn't always what's right.


I understand and agree with your sentiments, with one exception: At this point in history I'm not sure why any rational person should give a single f*ck what the 'founders' intended. They were men of their time - that is to say racist, mysogynist slave-owners (for the most part), who launched a revolution over a tax increase. That, and it was hundreds of years ago and the world just may have changed a bit.  F*ck 'em.

Yeah, I don't disagree with you. But the principal is still "shall make no law prohibiting the free exercise of [religion]..." And there is wisdom in that. It's just that that wisdom doesn't stand up right now.

is in conflict with "nor shall any State deprive any person of life, liberty, or property, without due process of law", as COVID-19 kills people, but they conveniently ignore that part.

To be fair [and balanced], most of the GOP has already contracted the disease, and have achieved herd mentality.
They've also suffered through Covid.
