FTA:"A birth mother's wife will never be the biological father of the child, meaning that, whenever a birth-mother's wife gains presumptive 'parentage' status, a biological father's rights and obligations to the child have necessarily been undermined without proper adjudication."

What "father's rights" does a sperm donor have?  According to the Googles, "usually, if a child is conceived through artificial insemination, and the donor is not the mother's husband, then he will not have parental rights or obligations with the child."

So, this AG is fighting on behalf of a straw man?  "Your Honor, this would harm the rights of the biological father, rights he doesn't have to begin with!"

I don't know if you knew this Mr. Hill, but the fields in the birf certifct are something we made up, and we can change them as we see fit

The Bar Association really needs to purge a LOT of folks. Like take a blowtorch to a good chunk. This isn't embarrassing, it's downright deadly to our legal system.

Shepard was perfectly willing to be part of the complaint but as chairperson he didn't want to get into trouble with the other members of his executive committee.  They had asked for more details of the suit but none were shared.

Agreed, but with the lawsuits that will entail, then the counter-suits, spiraling around and around for the next twenty years, the courts won't be able to do anything else.

Also, what happens to a state Bar when the lawyers start picking sides along political lines?

This all is the result of the litigious environment that has been fostered in America over the last 30 years.  If this type of thing was nipped in the bud (i.e. the state Bar Associations started the crack down your asking for in the 90s) then Trump would never have been President to begin with because he would have been a failed business man 25 years ago.

Not reading tfa, I was extremely confused about how lesbian parental rights had gotten involved with voter fraud to keep trumpy POTUS.

The insanity we are going through is clearer than ever: I didn't think you posted in the wrong thread. I accepted that a Trump lawyer would be that farking nuts.

Trump and the other plaintiffs would have good grounds for malpractice lawsuits against most of these lawyers due to the sheer incompetence of the legal filings.

As for official sanctions and disbarment, they've crossed the line many a time and done things that should result in official punishment, but there's almost no chance of it actually happening. Because judges and bar associations let shiatty lawyers get away with a lot of stuff.

This, however, is one of the few things with a decent chance of getting some official sanctions thrown at the Crack-hen

At what point is it just malpractice?

The point at which our justice system or the Bar Association does jack shiat about it.

So, if you claim in a court filing that you're representing a person, and the person denies that you have permission to represent them, isn't that something like "material fraud upon the court"?

abb3w: So, if you claim in a court filing that you're representing a person, and the person denies that you have permission to represent them, isn't that something like "material fraud upon the court"?

Maybe if the person makes that denial in a complaint to the formal disciplinary board in the state where the attorney is licensed, or at least to the court where it was filed. As opposed to making the denial to Greg Bluestein.

lilbjorn: At what point is it just malpractice?

*sigh*

Because a claim of malpractice has to come from the client, not the Bar.

The only thing judges can do in these cases is sanctions and contempt charges. The Bar might start ethics violation investigations, depending on their state rules.

But disbarment, or malpractice, only come after a client complains. Not the public.

I'm skeptical about how vigorously Cobb County GOP chair Jason Shepherd, who said he would be willing to be a plaintiff in the case based on some contingencies of which I don't know the specifics, is willing to push back on Sidney Powell acting (essentially) as an advocate for Trump.

It appears to me he's trying to walk a public image tightrope. He wants them to keep fighting, but has some fear that direct association of his name with an increasingly delusional pursuit will be harmful to him.

2020-11-26 2:44:34 PM
it's odd that there's always talk of "troubling issues/fraud" but never any discussion of what these "troubling issues/fraud" exactly are...as if it's just all a smokescreen...
