None whatsoever in my mind.  Democracy died last night.  My only hope as a gay, childless female is that Canada starts taking refugees and Gilead doesn't get to Alaska before I can get across the border.

I'm okay with this, as long as the opinions of Associate Justices Obama, Obama, Clinton and Clinton are given their due consideration.

I think Trump's gonna have plenty of his own legal troubles after this January, Subby. And he won't have Barr giving him free legal service at that time either.

defamation suit

Rape. Donnie raped a pretty blonde woman that looks eerily similar to his ex-wives and then said she wasn't his type. Republicans told us that she'd disappear after the 2016 elections, but she's still fighting the good fight.

/yes it's still a defamation suit since Donnie is the one filing but let's not be pedantic just this once

Is there a point where these lawyers can be disbarred for having such frivolous positions that are just there to run out the clock?

Good news!

As of July 2020 she no longer considers America a Safe Third-Country

Therefore you have a pretty good chance of getting political refugee status when the officially sanctioned 'morality prosecutions' begin!

I looked up my own answer. If you have a position that is obvious not a legal position, yes you can get in trouble for it.

Well the USA is the country that led the neoliberal campaign to defund Philosophy, History, Art, and Literature programs in college. Those are where arguments are made and jurisprudence is made important in a democratic society. The USA took the big shiat on jurisprudence and replaced it with police brutality and party politics when they chose STEM over building a culture around argument and logic.

How long after the fact could she have sued him for defamation? If she could have waited until Jan. 21, he wouldn't have the option to use the power of the federal government behind him.

That had less to do with neolibs and more to do with capitalism as a whole. If you can't sell it with free shipping, it's useless.

Since it's 2020, we all know what will happen. SCOTUS will overturn it and allow the DOJ to defend Trump. Trump will win a 2nd term. Justices Kagan and Sotomayer will take a vacation to a volcano that will explode, eradicating all life in a 20 mile radius. Justice Breyer will pick up the newspaper the next morning and have a heart attack and die at the news. Mitch McConnell rams through 3 more justices before inauguration day, then chugs down an elixir of immortality allowing him to remain Senate Majority Leader for eternity. Nancy Pelosi gets caught jaywalking and Fox News blasts her for her immoral, illegal behavior. The GOP takes back the House and sends through an amendment outlawing the Democratic Party. The Senate approves it, Trump signs it. House Democrats try to appeal it, but the 9 conservative justices say it's entirely what the founding fathers would have intended to do, so tough shiat. Liberals get pushed into concentration camps where we're systematically killed off by whoever contributed the most to Donald Trump's campaign. Godzilla rises from the coastline near Fukushima and destroys the entire state of California. The remaining 55 electoral votes that California once had are redistributed to Alabama, Louisiana, Missisissippi, and Arkansas.

Obamas maybe, but the Clintons are too old. Some nice young jurists who will sit on the bench for thirty to forty years.

Justice Tlaib doesn't sound like a bad idea.

This is Barr's strategy to replace every single pendent outstanding lawsuit of which there are literally thousands the name of DJT as defendant or plaintiff with United States of America.

Donald farking Trump is not the USA but that's exactly what they're trying to pull. It's beyond preposterous.

It will take Biden an entire presidential term or more to get the Trump stank out of the federal government. It's going to take generations to get it out of the SCOTUS

This has nothing to do with STEM unless you think STEM stands for " Sales Tax evasion rEganomics and Marketing.

The new focus on pushing science, tech, engineering, and math is in no way incompatible with logic. All those fields are fundamentally logic based, much more so than basically anything else.

If she sides with Trump and the DOJ, she is BOUGHT and we should let her and everyone else know for the entirety of her term that she is compromised and BOUGHT at every turn. There should be no let up that she is tarnished and her word means nothing.

What this does it s expose the SCOTUS & Republican Party for what they really are.
They're gonna have a real hard time maintaining minority power.

I mean, the DOJ's argument here, is that defaming someone who claims the President raped her before he was President, is actually part of the job of being President, despite him having defamed her before he was President.

If SCOTUS lets the DOJ stand in, it would effectively kill the case, because if the actions were actually part of his responsibilities as President, he would be indemnified. That said, the only way to get to that conclusion would be to ignore the law, ignore the facts, ignore common sense, and absolutely decimate the credibility of the court itself  right out of the gate.

Who, Justice Handmaiden? I'm sure that will make her feel oh so bad as she gleefully votes to roll back rights for most of the country to 1850s standards.

When you see the panel of the SCOTUS that hears the DOJ plea, a panel all wearing balaclavas with their robes, you'll know that justice is blind and bleeding out somewhere in the basement amongst the instruments of torture, Con Law Kaplan notes, and and a case of Jesus juice, liberated from a heretic church.

Zaphod42: It will take Biden an entire presidential term or more to get the Trump stank out of the federal government. It's going to take generations to get it out of the SCOTUS

The stank will never wash off Moresuck, BeerBro and Aunt Lydia. Never. It's why they were chosen.

But SCOTUS as a whole? Easily done. I mean easily done. The 117th Congress changes the number of seat to match the number of appellate circuits. President Biden signs it. Bang now it's 7-6 and if you think we pick anyone but the youngest, wildest-eyed, fiery-hearted lions we can find from public defender's offices, ACLU, SPLC, AFL-CIO and BLM to fill those seats, you got another think coming.

The right-bent theocratic loons will regret these shenanigans to the end of their days. With any luck McConnell will suffer a series of debilitating strokes leaving him paralyzed, unable to communicate but fully conscious of his surroundings and will linger in that pitiable state long enough for President Ocasio-Cortez to fill not only the seats of the retiring Breyer and Sotomayor but those of the deceased Thomas and Alito as well.

They wanted to change the tenor of the court and they intended to stick it to the rest of us with their power-grabby lunacy for decades.

Sen. Harris was right. We will not forget it. I will add that we will not forgive it, either. Decades of 9-3 decisions with poor Chief Justice Roberts helplessly tacking between what he knows is right and whatever programmatic idiocy The Trump Judges - as they will forever be known - spout in defense of corporate feudalism and Gilead-style theocracy ... that sounds just about right.

If they feel bad about it? We've already established what people can do with their feelings.

Demographics take care of the rest. The zoomers are now the largest voting bloc.

The problem, as always, is that no one believes that we need both. STEM, so that we have people that know how things work. Liberal Arts, so that we have people that know why we should have those things.

Correction: the defamation claim stems from Trump's comments in June of 2019 (at that time he falsely claimed he had never met her and that her book was a work of fiction).  So he was indeed President at the time that he lied to defame her.

That said, it's beyond ridiculous to claim that the statements were made as part of his role as president, or that making defamatory statements fall within the scope of his duties. It's tantamount to claiming anything someone does while president is part of the job, and thus may be defended by the DOJ (which means basically anything can be dismissed immediately upon claim of sovereign immunity).  In a just world, Barr would be impeached for this. However, we're in 2020 and it's somehow conceivable that Trump can "win" this with a complicit Senate and majority of the SCOTUS.

The founders thought a king was so awesome that they rebelled against one, therefore Donnie should be president for life.
