There is no open carry in Florida.  This is a common misconception that Florida let's people carry openly.  Now some local police will look the other way, because they don't like arresting rich white tourists, but it only takes one with principles, or in this case you not being a rich white tourist, and you are farked.

laws like that are specifically put in place to keep the black man at a disadvantage to whites.  It's just a continuation of Jim Crow racism In the south.   The whites can have guns but, be black and you go to jail.

Under Florida Statute 790.25 certain limited conditions exist in which open carry is legal. Such conditions are if you are traveling to or engaged in camping, fishing, hunting, or lawful target shooting.

The big question at a preliminary hearing is what gave officers probable cause to detain him, search him, and find a firearm in his possession?

If he wasn't on the video brandishing a firearm, that's not cause. If police didn't directly observe him in possession of a firearm, that's not cause.

The question is going to be WHY was he detained and searched. If police say they did it "Just because he was present," well, that's not going to look good.

We also only have the word of his wife to go by that he wasn't involved. Bottom line is that he was a convicted felon with a loaded gun so maybe let's not be giving him the benefit of the doubt here.
