Fundies would argue, though, that abortion is Itself a death penalty, that they take their laws from God and not "the government," so it doesn't matter what anyone else thinks. These are not people who should be judges period, let alone on the Supreme Court.

Whenever ive had to debate abortion with a pro-lifer i always ask them what they think the punishment should be for women who have abortions.

They never seem to want to punish the woman, they always want to lock up the doctor and let the woman go free. Which is weird because if you hire a hitman, they dont arrest just the hitman.

Like with most things, conservatives dont seem to have thought it through that far.

Some of the abortion laws written in southern states punish the doctor with murder, some punish both with murder.

And some have no exceptions for rape nor health of the mother.

Bennett was nominated to the court because she will undo everything that GInsberg achieved.  Period.   Much like trump attempting to reset eight years of Barrack Obama, the republicans care little about the potential collateral damage, as they are blinded by personal hatred.

It's going to take decades to undo the damage of the last four years.

Wrong. If it was a "baby" it would have a SSN and a birth certificate. Furthermore, a 3rd trimester abortion is only allowed under the most extreme circumstances. And furthermore, again, it's a matter between a woman and her doctor.

Why are you talking about third trimester abortions?  Do you have any idea how exceedingly rare they are?  In the rare instances they are performed, they're done for extreme medical reasons involving life or death, or due to horrifying situations so grotesque that the law is not equipped to handle the situation.

"Convenience" third trimester abortions are somewhere in the single or low double digits each year.  Doctors simply won't perform them in general.  Rights to abortion access is about where ~99% of medically elective abortions take place - in the first few months of pregnancy.

Going off on third trimester elective abortions is like making automobile safety laws to curb the existence of pink Triumphs that roll coal.  Focus on the legality of things that exist in large enough numbers to matter.

Remember in 2016 when Trump was asked about this, and since he doesn't really have a position on this because it isn't about him, he went through the logic of the question and said that yes the women should be punished?

But the belief in inconsistent.  So inconsistent that you quickly realize they don't actually believe what they're saying from head to tail.  When you follow through with what this fetal personhood idea entails (which is what you'd need to call it murder), they balk at nearly every consequence.

They SAY they believe it's "murder", but they don't see frozen IVF fetuses as eligible to get Medicaid benefits or be counted in the census.  Miscarriages aren't cause for a murder investigation, nor should they be counted in death statistics.  Sure, a few will pound the table and say those things are correct, but the bulk of people advocating for personhood amendments just create other loopholes to set those ideas aside.

Because the purpose is the create a twist in the law that gives a punishment for sex that wasn't intended to reproduce.  That's it.  It's enforcement of a moral code based in religious thinking.  Not a clear legal framework.

Both of my goddaughters were born via IVF. Their parents are both hardcore Republicans and voted for Trump. I asked if ACB's view on this was concerning to them and they said no because we got our kids while it was legal. When I said what about if your daughters have the same issue. They said well...it will probably be legal in a few blue states...they can just go there.

I think its a touchy subject because the issue is always dropped there since 1 daughter wants to be a ACLU lawyer mainly in the area of voting rights for minorities and the other wants to be a social worker for immigrant children.

Every election matters. This nomination didn't fall from the sky.  It's the result of 20-30 years of anti-abortion voters coming out and casting their ballots several times every two years. Primaries, runoffs, generals. State legislatures, state attorneys general, off-cycle congressional, off-cycle senate... the elections with 33% turnout matter. Stop sleeping on them. This is what happens.

"Could" or "should?" Because if your question is "COULD abortion be punishable by death," well who the fark knows? Anything's possible with THIS administration. Now, if your question is SHOULD, then that's a question ACB can actually answer.


No, "could" is an appropriate question as well. It requests that the potential jurist analyze the question with respect to constitutionality, which would be...you know...her entire farking job if she's confirmed. It's not unreasonable to ask her what her thought processes might be if, for example, Mississippi or Alabama decide that a clump of cells has more rights than the ambulatory uterus hosting it.

Both of my goddaughters were born via IVF. Their parents are both hardcore Republicans and voted for Trump. I asked if ACB's view on this was concerning to them and they said no because we got our kids while it was legal. When I said what about if your daughters have the same issue. They said well...it will probably be legal in a few blue states...they can just go there.

I think its a touchy subject because the issue is always dropped there since 1 daughter wants to be a ACLU lawyer mainly in the area of voting rights for minorities and the other wants to be a social worker for immigrant children.

Wtf is this 3rd trimester nonsense that always comes up? Most people want 1st trimester pill abortions. Those 2nd trimester abortions are almost always for a dead fetus or an inviable one, or life threatening condition of the mother. You don't want a baby, you tend to decide that early. 20-24 weeks is max in this country without some crazy mitigating circumstances. This partial birth nonsense is just that: nonsense.

Cousin had a 23 week a 5 day abortion on a trisomy 13 fetus. They knew about it at around 20 weeks and her doctor farked around trying to convince her that every life was sacred even though it would probably die before birth, and even if the baby was born, it's less than a week life and just pane management. He tried to keep her from it till the 24 week window was over. She found a new OBGYN after that. fark that guy and the farmer congress man who said cows push out dead babies why not human women?

Every election matters. This nomination didn't fall from the sky.  It's the result of 20-30 years of anti-abortion voters coming out and casting their ballots several times every two years. Primaries, runoffs, generals. State legislatures, state attorneys general, off-cycle congressional, off-cycle senate... the elections with 33% turnout matter. Stop sleeping on them. This is what happens.


This. When talking to the wife recently I realized that the leftwing and their (our) "revolution" is silly as fark. Everything that fundies have done, they did slowly, methodically, and through the system that's in place. For the left, our lack of civic engagement got us here, nothing more.

We are a center-left country with an extreme far-right government that was voted into place. That happens because of complacency.

Pointing out the serial hypocrisies of the "right to life" movement is the easiest thing in the world.  Even Trump, during the 2016 election, figured out that, if you make abortion illegal, the woman who chose the abortion must be punished along with the doctor who performed the abortion.  His handlers, however, quickly informed him that the official anti-choice line is that the woman is a victim, not an accomplice, so she can't be punished.  Of course, it's easy to view the woman as a victim when you think women have no agency and shouldn't be trusted to make decisions for themselves.

According to the rules of the Senate a vote cannot be taken without a quorum, which requires at least 2 Democrats to be present. But Republicans don't care about the rules, and no one's going to stop them.

What should worry people more is that Barrett is someone who is probably on board for expanding the crimes for which the death penalty is applied to them.  It's usually flown under the radar, but there are many Republicans who think that death should be a punishment for more crimes than just capital murder.

If someone needs an immediate organ donation to live, and you're a match, if you refuse to give it to them are you a murderer?  Should the government have the power to force you to give your extra kidney, or some bone marrow, or a piece of your liver, to someone who needs it?

My guess is that you'd say no to both things.  If you don't, you'd be in the vast, vast majority.

The question, then, is why you think it IS okay to force women to donate the use of their organs to a fetus?  Or why refusing to do so is murder, but not the case above?  Or why you think women deserve fewer rights than a dead body?  After all, we don't even violate the bodies of corpses without the previous consent of the dead person.

She was the only real candidate who was qualified to be POTUS who was running. That was obvious. And yet people who don't know any better, still voted for Trump - like it was the election for Student Council President.

When it comes to the Republicans?

In both Republican controlled Virginia and Georgia Legislatures, during this past decade, the R's presented bills to require women to report ALL miscarriages to local law enforcement.  The Authority that is must determine whether the woman might have criminally contributed to the expelling.

Why, yes, between 10 & 15% of all pregnancies end in "self induced abortion" (miscarriage).

I'm sure this religious bigot will see her way to a majority opinion on death penalties for "flushing"

Oh dear God I feel sorry for what I am about to type

When you accept that a woman should have no agency and is simply a vessel for bearing children then punishing one makes as much sense as punishing an appliance.

You have to first accept that women are full members of society with the same ability to make ethical, moral and practical decisions before punishing one.

If Roe is overturned, the abortion issue will - at least initially - go back to the states.  And if you want to invest in abortionplexes, the place to do it isn't in California.  There are currently 13 states and one federal district that have legislation on the books to preserve a woman's right to choose in the event that Roe is overturned.  Most of those jurisdictions are in the Northeast and the Pacific Coast.  One of those, however, is in the middle of the country and easily accessible to a large number of red states - Illinois.  Seriously, if you have some money and are looking to invest in a sure-fire opportunity in the post-Roe era, invest in an abortion clinic in Illinois, preferably on the border with Indiana or across the river from Missouri.  And if you can also invest in the pot dispensary next door, you will never have to work again for the rest of your life.

Even your anti-choice people recoil at the thought of killing a desperate woman.  She would be guilty of murder for hire in their view of the world.  The doctors they see as pure evil so they have no problem killing them.

If you make it illegal there may be no doctors to kill, but plenty of women will die.


Hell, I think most anti-choice people would recoil at the thought of incarcerating/restraining/sedating a woman for the length of her pregnancy if she indicated that she would abort. And yet that's the slippery slope they're heading down.

Many left-leaning and middle of road women from key battle states didn't vote for Hillary because reasons and such... even though the next president (fark you McConnell) was going to pick a SCOTUS to replace Scalia, who died in Feb of 2016.  That alone should have been enough of a reason for anyone that cares about women's choice to vote for Hillary in 2016, since there were 8 or 9 months of a heads-up that a new judge will be nominated by the next POTUS.  As it is turning out, Trump is going to replace three judges, all with conservatives views.

In the near future, if any of these 2016 women that didn't vote for Hillary need an abortion, they might be SOL.

Anyone in the third trimester wants to have the baby.

Every human body is unique. They malfunction in unique ways, and the consequences can range. The only person with all the facts available are the person that owns that body. The second most knowledgeable person is the doctor treating them.

Thinking that you know better than a woman who has carried a fetus for 6 months requires a great deal of pride.

Asking judges how they would rule on hypothetical cases is pointless. Getting bent out of shape about what has effectively been precedent for 30+ years is even more pointless.
