Sidney Powell is going to wind up in a crate being shipped to Nigeria labeled "Diplomatic Bag" if she keeps farking up at the rate she has been. (sorry if that's too dark)

For Executive Privilege to work, she would need to be an employee of the Federal Government working in the executive branch & her discussions regarding this case would need to be matters of administration policy.

If either of those things were true, she would likely be conflicted out of being able to represent Flynn. She can't represent Flynn while working for one of the interested parties in the case, & she definitely can't coordinate legal strategy with one of those parties without disclosing it.

Um....I'm relatively sure that one cannot successfully invoke executive privilege unless one is working on the direct instructions of the POTUS.

Even then....in this case, I'm pretty sure that this action would constitute obstruction of justice.

The prosecution works for the executive branch.

The defense lawyer briefs the head of the executive branch on the ongoing defense strategy.

Seems legit.

For those that are wondering, this was a not insignificant part of what lost Clinton the election. Because of the "optics" of that meeting, Loretta Lynch stepped back from the "e-mails" issue, allowing Comey to step in and bungle up how to actually manage PR for such a sensitive thing.

I wouldn't have. They've had time. At this point, if not some time ago, they and Flynn need to own every fark-up, not let it derail or delay the proceedings.

If anybody is in the wrong, it's Sullivan.  Why does it matter who Powell talked to?

The question shows bias (again why would it even matter to him) and it could potentially influence a jury.

Sullivan is going to keep messing around and get himself into trouble.

Since you can only invoke executive privilege, when you are actually advising the executive...aka the president; her first answer was kind of a "tell"

This isn't per se illegal, as the President is technically the head of the DOJ (we may need to change that, r at least set up a parallel prosecutorial authority that's outside the executive Branch the was the GAO is or a special prosecutor is).   However it provides a LOT of justification for the judge to ignore the DOJ's request to drop the case and dismiss the charges.   The DOj is acting like this isn't so, but ti stopped being THEIR case the minute they walked into a courtroom and convened a hearing.   After that they need the Judge's approval for everything including accepting a plea deal.  And given Flynn ALREADY plead, AND "Allocuted"  (Gave a detailed confession of the crimes he committed in open court) it is WAY too late for the DJ to be waving around the "prosecutorial discretion" flag
