That doesn't preclude the fact that a court forcing a company to restrict speech violates the First Amendment.  Now, if FB did it on its own, that's fine, because it's a private organization (business) doing its own thing.

Now, if FB doesn't do the right thing on its own, it's up to the paying public ...oh.  It's up to the general public to abandon Facebook and use something like Google Pl...oh.  It's up to the general public to abandon Facebook and use something like TikT...oh.  ...It's up to the public to abandon Facebook and use something like Myspace!

I'm not saying that I disagree with the infographic; but it just seems that having a court tell FB what kind of speech to allow won't past muster in a higher court, should such a thing happen.

They're using Tort liability under a negligence theory and asking for the injuction as a remediation of the negligent condition.


They're arguing essentially that FB has a duty to keep their platfrom from being used to coordinate violent and lawless conduct, and that they breached that duty by not removing this content.

Normally you could argue that FB is free from liability  under the COmmunications decency act which shields providers from liability for  user-generated content.  However FB my have destroyed that safe harbor claim by actively policing their site and  setting forth policies on what is and is not allowed, the Plaintiffs may have a reasonable argument for holding them to their own policy
