Despite what TFA says, the ACA is on life support as it is. Right now, there are eight members of SCOTUS. The ACA is on the calendar in the beginning of November. A 4-4 decision will not disrupt the 5th Circuit decision below.

The 5th Circuit ruled the mandate unconstitutional, since a penalty of $0 is not a tax. But they punted on severability. I can very easily see some kind of split decision, where Roberts crosses over to say the $0 penalty remains constitutional. But that gets us to 4-4, and the 5th Circuit finding of unconstitutional would stand. And then Roberts joining a 5-3 majority saying it's not severable.

He wrote the decision stating it was a tax. He very well could say that provision is not severable. He based his whole decision that the ACA was constitutional based on the tax. It's not far fetched to think he would believe the tax is essential and non-severable.

TL;DR: The ACA may already be dead with or without an extra Trump appointee.

Do you have proof of that last point because evolution has been accepted within the Catholic Church for damn near a century?

They could have pointed out the things about her that makes a goddamn psycho in half the space and been all you need to know.

The one thing that should be noted.

If... or should I say when the SCOTUS strikes down the ACA, I expect votes on M4A to be occurring within the month and a bill sitting on Biden's desk within a week or 2 after. At which point, without the ACA in play, he will have little reason not to sign it. The stripping of the ACA would push even Biden over to the universal healthcare side. They'd have literally have given him no alternative.

To be shot down in the SC. Need to get to 13 justices first. In my view before anything has a reasonable chance of passing.

FTA: Can job applicants sue employers whose policies have a disproportionately deleterious impact on older people? Barrett said no. Should courts halt the deportation of an immigrant who faced torture at home? Barrett said no. Should they protect refugees denied asylum on the basis of xenophobic prejudice? Barrett said no. Should they shield prisoners from unjustified violence by correctional officers? Barrett said no. Should minors be allowed to terminate a pregnancy without telling their parents if a judge has found that they're mature enough to make the decision? Barrett said no. Should women be permitted to obtain an abortion upon discovering a severe fetal abnormality? Barrett said no.

Normally I'd diss Slate but this was in the third paragraph.

What makes you think the Supreme Court would just not go ahead and rule Medicare (For All) unconstitutional?  If the GOP goes ahead with this and the Dems control the Executive and Legislative branches, matching the number of justices to the number of district courts is the way to go.

How do women like that who run for office reconcile their purported religious beliefs with the pushiness needed to run in the first place?  It seems to me that any time they tried to speak up in public debate, all some man would have to say is "1 Timothy 2:11-15, biatch!"

It is my understanding that Trump has a replacement for the ACA that he will unveil in less than two weeks. I'm sure that he isn't lying because this time is different from all the others.

If the ACA (a/k/a the Big Farking Deal) is gone, that would be a serious impetus for Biden to support the next step. If you can't rely on the already-compromise ACA being there, why not go further? You know he'll be feeling the pressure, and Biden is a Company Man. If the majority of the Reps want it, he's more likely to go along with it. It's not 2009 anymore.

If Trump packs the court with a nominee, when Biden wins the election, then he is politcizing the court. Democrats must therefore de-politicize it by expanding the Supreme Court to 11 members.
