Throw in a Judicial  reform act that sends all the trumper judges to a new circuit in ND with very limited jurisdiction  and he has a winner. Congress has absolute control over all Court and Judges assignments under SCOTUS.

Reform the Judicial Act to tie the number of SCOTUS justices to the number of circuits. Seems like that would be harder to just add justices after that, since you would have to add a new Circuit per justice.

The new gerrymandering will be a pile of small Republican circuits being made at the next chance the GOP gets.

Make it Pahrump, Nev., and make the circuit cover Area 51 and nowhere else.

I agree and I think that it should include splitting the 9th up to make 13.

also need to make DC and PR states, so long as PR still supports it.

The Eleventy-Ninth Circuit Court of the abandoned strip mall outside of Bismarck will have 300+ judges hearing all cases pertaining to federal guidelines on septic-tank related deaths. We will have a large septic tank installed on site specifically for them.

Is the Article I power to set the court absolute enough to survive a constitutional challenge?

2020-09-19 5:13:31 PM
Yes, situation is that dire.

No, packing the court and raising the number of justices is not the only solution. Mostly, because it is not a solution a t all, to the real problems:

The GOP SCOTUS would block all of Biden's moves to restore agencies and laws.

Kavanaugh needs to be impeached.

Trump's federal bench needs to be, mostly, impeached.

Police need to go to jail for what they did this summer.

...
Packing SCOTUS does not help with those 3 things. It would be a red herring to pursue, and it would delegitimize all the legislation and appointments Biden needs to do. Since there are so few police in each agency that disagree with Trump now, pre-emptively delegitimizing Biden's laws and leaving it to the biased police to enforce would be national suicide.

Here's a better idea: How about requiring more than just Senate approval for a Justice? House and Senate, or maybe even an election.

Another thing: Let's stop with this "appointed for life" crap. It's stupid. Supreme Court Justices should be appointed for 12 years. That's it. The year they're done, they're done. They can't be in the court again.

You need 66 votes in the Senate to remove an impeached judge - getting a majority MAY happen this year, getting 66 seats?  Pipe dream - and the pipe is full of hash man.

Do it, AND open up investigations on every Trump-supporting GOP member of Congress for the crimes it's pretty clear they've committed.

Reduce their numbers via legitimate arrests, as the party of law and order.

They'd claim it anyway. He's not gaining any new GOP followers by NOT saying it out loud, however, he might gain support from the left by showing that he's willing to fight.

It's not about fair, it's about getting what they want.  The things evangelicals want are very important to them.  They have the Senate and the President, question is do they have time.

If you're going to do that, just get rid of SCOTUS all together and have the Chief Justices of the circuits meet once a year to serve the role.  Have the Chief Justice position rotate every few years to break up cabals, require a 2/3 consensus for a ruling to be binding.

I like the idea of every POTUS gets one per election term, and since the Senate is garbage, they get no say.

The number of justices can shift over time and that's ok.

Better yet, in rotation have one person act as sort of an Executive Officer of the Week, but all decisions of that officer have to be ratified at a bi-weekly meeting with a simple majority in the case of internal affairs, or a 2/3 majority for external matters.
