This whole thing is just another sad example of how there is no karmic justice or fairness in this world.  We have a damn pandemic of a fatal disease going on, with these chucklefarks flouting the safety rules on top of that.  Many of these guys are super old and in poor health.  Yet not a single major player among these guys has gotten even a bad case of it (Herman Cane doesn't count).  Meanwhile we lose RBG, John Lewis, and a long list of artists and entertainers who where positive contributors to society.
While Trump and his people have had a tremendous political advantage, they've also been lucky at every turn since the 2016 election.  They've gone through scandal after scandal with no real consequence. Surely they would fark up so bad at least one of these times there would be some real repercussions.  Nope.  Endless bad results, no karmic balance.
Anyway.  I just needed to rant a little.  The situation sucks and will continue to get worse for the foreseeable future.  I plan on voting and giving to various charities and democratic campaigns in the meantime. I'm going to continue to try to look for a bright side to this situation, but its been real hard.

See:  Dems need to pack the Supreme Court thread.

The Presidency is favored for Biden, the Senate could go either way.

Give to Senate battleground states and we could see this:

2 states added (DC and Puerto Rico), so 4 more democratic senate seats.   Plus the GOP having another brutal election there in 2022 when they are defending more than twice as many seats.

And then move the number of SCOTUS justices to match the number of US circuit courts, which is 13.   That rationale has been used a couple of times in the past to change the number of justices.

None of which is possible now.  There is no path that allows that to happen.
Biden can't win the election now, and McConnell will guarantee that.  He will have someone on that bench by next week.


This is my biggest fear. McConnell pulls every favor, makes every empty promise, all hinging on "if you just fall in one last time, with this SC appointment we can steal the election, and then we will be in a position to never lose power again". And it will probably work, and with that the Republic as we know it will be well and truly over.

The loss of RBG is huge in a multitude of ways. She'd have been tough to replace in quality even if the libbiest libs controlled every aspect of the government. She was a unique and rare person. Her kind does come along often.

The fact that she'll be replaced by some unqualified gop stooge, a trump stooge no less, really is tough. We've got trump appointees who are literally illegally occupying the position and nothing is done. The jokes about Falwell aren't that funny because they'll probably try to get the same type. We've plenty of evidence they don't even care about finding qualified people to fill roles.

America deserves better than what they're going to give us. Even pigfarking trump voters deserve better even if I don't care if they're eventually farked over by all this too. A group of the most disingenuous, corrupt, unethical pieces of garbage are going to put the same on the bench and then try to run our lives. No sane person should be ok with this.

Republicans told Obama they would support Garland, even going so far as to say, "Obama should nominate Garland, but he won't."  No one Obama picked was going to be approved, because the Senate Republicans were refusing to do their duty to advise and consent.  shiat, they could have voted Garland down and at least have a figleaf to cover for their abuse of power, but no, they couldn't do that, because Garland was praised repeatedly by them.

The issue, though, is that the Enemy will not try to replace her with a "boring-ass moderate", but with a full on Trumpist, probably someone egregious enough to argue that the 22nd Amendment doesn't apply to Trump.

Of course this is going to be a national disgrace; the Enemy doesn't care. Unless you can literally imprison the entire Republican national caucus, milquetoast is the best option, with open treason far more likely.

Trump's only hope is everyone who supports him turns out. The best way to turn out evangelicals is to have that open seat in jeopardy.

They can get the best of both worlds by waiting until the election. If they win they can say they were being honorable and letting the people choose. If they lose they can pass a judge through a lame duck session and have avoided a lot of the fallout during the campaign

Oh they'll have the votes. The entire election hinges on prematurely declaring Trump the winner. They'll call all The Families in for every Favor.

Trump's only hope is everyone who supports him turns out. The best way to turn out evangelicals is to have that open seat in jeopardy.

They can get the best of both worlds by waiting until the election. If they win they can say they were being honorable and letting the people choose. If they lose they can pass a judge through a lame duck session and have avoided a lot of the fallout during the campaign

They can't guarantee the election win without having someone in that seat.


They have a 5-3 majority right now. 2 being Trump appointments, thomas having voted for bush v gore and roberts and alito having been appointed by the guy who won it.

They don't need the extra vote, and their other efforts to disrupt the election are more likely to swing it well before it gets to the SC.

I was feeling dread about 6 weeks ago, and it lightened up about 2 weeks ago.

Now that feeling of dread is back and it's 100 fold worse than my initial feeling.

I honestly believe America is done and that sometime within the next 2 years (or less), my SSDI will be taken away, as well as my son's and mine SNAP benefits, and my son's Medicaid. We will be homeless before those 2 years are up & there won't be anyone who will help us, as all social safety nets will be dismantled. 

RBG passing is the absolute worst thing that could have happened right now.

I am scared beyond words.

They are tripping over each other trying to find their seats so they can fill it in record time.  Conservative majority over SCOTUS means they will never need to worry about an election ever again, as they can challenge any result and have the court rule in their favor every time.


Filling it before the election takes it off the table.

There's the possibility evangelicals decide that they got what they wanted and don't show up in numbers. There's also the possibility that senators in tight races would be hurt by it. Look at Collins she's paying for kavanaugh right now. Another vote for a pro life judge and she's buried. There's several senators that would rather not have a decision and would rather run on filling an open seat. Finally I can't possibly think of a better way to galvanize the Democratic party than a new sc justice a couple weeks before the election. Anger is a powerful force.

Almost all of this is avoided by just waiting for the lame duck session.

Prediction: McConnell won't have the votes to confirm a nominee because vulnerable Republicans will reject the idea of hitting the blue voter hornets nest with a stick because they are already swarming enough as it is. That said, on November 4th after it doesn't matter, those votes will magically materialize regardless of the outcome because the senators will have either lost and go into lame duck mode or they will have won and go into "this is the will of the people" mode.

One other nugget to keep in mind. Since Mark Kelly and McSally are a special election, the winner can be sworn in almost immediately. They don't have to wait until January.

Individual senators have the power here. If 4 senators decide that they won't confirm and stand firm it doesn't matter what McConnell and Trump want. McConnell is throwing up trial balloons. He'll back down if he has to.

My guess is they milk it for all it's worth, Trump spends a bunch of time talking about it on the trail, he floats names for weeks getting news cycles and he appoints someone on the eve of the election to get a big announcement. At risk senators use the election as an excuse but are careful to make it sound it's because of how busy they are and how it needs their full attention. If they lose they can then say that they are able to focus during the lame duck session and vote to confirm.

Back when RBG experienced health problems during President Obama's second term, I was wishing she would retire as she was throwing fate to the wind.  Once Trump was elected to the presidency, I hoped she could cling to January 2021.

All that being said, I knew McConnell would be a hypocrite.  Assuming he pulls his stunt, then I hope the Republicans take such a drubbing at the ballot box that they are in the Senate minority for the next 50 years.  It has happened before.

McConnell knows they've lost the Senate.  His one goal throughout his past 20 years of service has been to pack the court.  At this point he doesn't give a crap about other Senators or Congressional elections, except his own, and he's solid.  All he wants is to pack the Supremes, and now at the 11th hour, he's got his chance.

Here's a deal. You can have your sc vote but all the Republicans who were derelict in their constitutional duty for the gorsuch nomination need to step down and leave the Senate. Sound fair?

Did the first impeachment proceedings stop the senate from seating judges? I was under the impression that nothing really has this whole time excepting the brief holds individual republicans have put on the process. Is there an actual rule or law that halts traffic through the senate while an impeachment is happening?


No.

The US government works through a series of "gentlemens' agreements." If people decide to do other things, in many instances there are not actual laws to stop them. And even if there were, when the Justice Dept is ruled by someone like Trump, they can simply decide to not prosecute.

Confirming a Justice before the election is one thing.  Confirming it after the election, especially if Trump loses, is completely different.  After the election, the people have spoken and said they want Biden to be president.  The people say they want Biden picking SCOTUS Justices

Also, picking one before the election gets that Justice seated before the election challenges all come in, where Trump sues every state that he loses in and ties up the election for months

They can't guarantee the election win without having someone in that seat.

They don't need the extra vote, and their other efforts to disrupt the election are more likely to swing it well before it gets to the SC.

No matter how the election goes, it will end up in front of the Supreme Court and Roberts is unreliable.


Even 4-4 just let's the lower court decision stand. And they've packed those courts.

I thought it might be comforting to know that even the most recent guy took almost 3 months to confirm. People keep saying McConnell will have this done within a week, but the process definitely takes way longer than that, unless there's some special legislative power he's hiding up his sleeve.


Now is when I miss Harry Reid in the Senate.

If there were an obscure rule buried somewhere that could be used to block this power play, he'd know about it and use it at the most opportune time.

I saw Murkowsky say that, who was the other one? As far as I know, the VP would be a tie breaker.

Gardner and Collins would probably defect out of self-preservation, too.

After the election, though? All bets are off. The Democrats would be wise to kidnap three or four Republican senators, stash them someplace safe and disconnected from the outside world, and then stay in their states until January 3rd.

If there are defectors, they will come from Romney, Murkowski (she's already said she won't vote for a nominee that is rammed through at this late date), Gardner, and who the fark knows about Collins.

One other nugget to keep in mind. Since Mark Kelly and McSally are a special election, the winner can be sworn in almost immediately. They don't have to wait until January.


Collins said a few weeks ago that she wouldn't support placing a new nominee. But yeah, doesn't mean she won't change her mind.

Expand the size of the SC and pack the court.

None of which is possible now.  There is no path that allows that to happen.
Biden can't win the election now, and McConnell will guarantee that.  He will have someone on that bench by next week.

This is my biggest fear. McConnell pulls every favor, makes every empty promise, all hinging on "if you just fall in one last time, with this SC appointment we can steal the election, and then we will be in a position to never lose power again". And it will probably work, and with that the Republic as we know it will be well and truly over.


postscript... we all might wanna start learning Chinese, since they'll be the global power in a few years (months?) if Mitch gets his SC appointment.

I would imagine any attempt to expand the size of the court would be challenged and eventually end up in front of the Supreme Court.  If Trump has a 3rd pick on there, there won't be an expansion


The size of the court has already changed through history. It just takes an act of Congress. There's no judicable controversy if Congress passes something and the President signs it.

I don't disagree, but I expect no votes until after Nov 3rd. Trump will try to leverage this inaction by painting the picture to conservatives that they can have the court if only they re-elect him. Which sadly may work for many people who had stepped away from Trump.

Roberts destroyed democracy with the Citizens United decision. Citizens United gave the United States to Russia (well, the highest bidder, which was Russia).

The Senate can't take up any business as long as an Impeachment from the House is sitting on Mitch's desk.  So Monday morning, the House should rush through an impeachment - lord knows there are any number of reasons for one.  Sure, Mitch would rush through an acquittal, but that would have bought at least a week, and by that time he'd be sitting on another impeachment.  Lather, rinse, repeat.

Totally legal and constitutional and a sure way to piss off everybody, but it would work.  Except Mitch would just ignore the impeachments, illegally, and go about whatever evil he has in mind.

They know they can't push the agenda thru congress so they are packing courts to undo all progressive legislation for the past 80 years. They will push it through before the election. Doing so equals total victory. They will not miss the chance.

They told him they'd be willing to confirm Merrick Garland because he was still a conservative jurist, if not quite as ignorant and blindly partisan as Scalia, so that's who he nominated.

Then they refused to give Garland a vote.


This was brilliant strategy on the part of McConnell, btw.  They forced Obama to pick a generic center-right white guy with absolutely no dedicated constituency on the left, and then sank the nomination.  If Obama had picked someone who inspired key democratic voters the obstructionism would have been major news, with protests, street theater, social media campaigns, the whole ladida. That in turn would have helped drive turnout for Clinton.  A woman or a member of a minority group (or both) would have been obstructed just as hard, but people would have noticed and some of them would have cared enough to get out and protest, vote, volunteer, donate, etc.  The driving narrative of the 2016 campaign would have been republican obstruction, a far better message than "I'll be like Obama but a bit more centrist."

McConnell may be a festering pustule on the ass of humanity but he knows politics. His handling of the Green New Deal was similarly skillful - he popped the bubble of media interest in under a week.

Graham went on record (more than once) back in 2016 that not confirming Garland was setting a precedent that he intended to uphold.  He even specifically mentioned if a Republican won in 2016 and a vacancy became available in the last year of his 1st term, that he would not fill it - which is the exact situation we have here

Now, he said a lot of things in 2016 that he doesn't honor now, so who knows if that will hold up or not, but there are at least two different videos of him saying that (once on a talk show, once in a Senate hearing)

Romney is a pretty definite 'no'

Grassley, who knows - he said he wouldn't (in the past) but now is anybody's guess

Murkowski and Collins will be against it right up until they vote for it, so don't count on them

I think McConnell can change any Senate rule by a simple majority vote. Much of the United States depended on politicians' honor.

This whole thing is just another sad example of how there is no karmic justice or fairness in this world.  We have a damn pandemic of a fatal disease going on, with these chucklefarks flouting the safety rules on top of that.  Many of these guys are super old and in poor health.  Yet not a single major player among these guys has gotten even a bad case of it (Herman Cane doesn't count).  Meanwhile we lose RBG, John Lewis, and a long list of artists and entertainers who where positive contributors to society.
While Trump and his people have had a tremendous political advantage, they've also been lucky at every turn since the 2016 election.  They've gone through scandal after scandal with no real consequence. Surely they would fark up so bad at least one of these times there would be some real repercussions.  Nope.  Endless bad results, no karmic balance.
Anyway.  I just needed to rant a little.  The situation sucks and will continue to get worse for the foreseeable future.  I plan on voting and giving to various charities and democratic campaigns in the meantime. I'm going to continue to try to look for a bright side to this situation, but its been real hard.


If you think this has a happy ending you haven't been paying attention.

Ehh, I think that the justices, while they may not all agree on issues, they agree on how the system should work. I doubt most of them would act like party hacks. Thomas would be the only pure hack on the court.

I think the Dems take the senate, especially if the GOP goes forward with trying to fill RBG.

Well that's fair enough then, impeach away. After a quick googling you guys are right. Blanche did agree to pause the judiciary committee hearings until after the impeachment. Of course, he'll just claim this impeachment is clearly political and ignore it out of hand, but still worth trying since there is precedent lol.

It's just my kneejerk response to roll my eyes when impeachment gets thrown about as a silver bullet. Don't get me wrong, if it ever will actually help I'm all for it. I just tend to lump it in with the "send the sergeant at arms" and "make them vote on it to embarrass them" posts. Both fine ideas on paper, both farts in the wind in practical terms. In this situation in any case. Making people vote on principled issues is a fine thing, just saying it won't ever stop the shameless from casting the votes to get what they want.

I honestly believe America is done and that sometime within the next 2 years (or less), my SSDI will be taken away, as well as my son's and mine SNAP benefits, and my son's Medicaid. We will be homeless before those 2 years are up & there won't be anyone who will help us, as all social safety nets will be dismantled. 

RBG passing is the absolute worst thing that could have happened right now.

I am scared beyond words.

Sorry about that.  That's horrifying.

Our only hope is that the SCOTUS does the right thing regardless of politics.


I used to have full faith in SCOTUS, then Clarence Thomas happened, and it's been downhill from there with the exception of Kagan.

This is why I don't like Conservative/Centrist Democrats like you, because you all are stupid and naive!

You think that because you nominated a woman in 2016, automatically you would have a win, no matter how much Hillary was perceived to be unlikable and ran a weak campaign. Now you're assuming that once the Republicans and Mitch McConnell act on their hypocrisy, which was predicted when they blocked Merrick Garland, you'll automatically have the Senate switched to the Democrats and be able to stack the Federal Courts with Biden appointees (having these thoughts when Biden isn't even elected yet)! Stop living in fantasyland and start actually working to win elections, stop assuming you'll automatically win as the "lesser evil"!

Don't lump everyone together. I think most of us know that you shiatheads are going to stay home again just like you did in 2016 and again in the primaries. There will be no senate flip, trump will win re-election, and his court picks will be cemented well enough they'll be there forever. Since you can't be counted on to vote, packing the courts would be a gigantic error as it's only a matter of time before republicans take over the government again and just fark us over worse. Congratulations, this must be a major win for progressivism.


It is a major win for progressivism, it proves that Centrist/Conservative Democrats running milquetoast candidates whom don't upset their wealthy donors allows fascism to take hold. Of course you blame progressives for "not voting" when twice there has been a conjoined effort to prevent progressives from winning candidates (especially Sanders), as well as Republicans suppressing the vote in historical Democratic areas (mainly cities) of Republican states, and then you use those constructive suppression to "prove" that progressives can't get out the vote. Also, you completely ignore the non-voter as a factor, which you can fix by making election day a state holiday in Democratic states so people can vote who had no ability before due to work schedule or other factors, as well as putting out political candidates who can convince people to vote for them with promoting good government ideas and policies!

Of course proving progressivism should have been pushed for instead of Conservative Democrats' "middle ground ideas, but settle for the Republican plan as a 'compromise' " is only a "I told you so". Still being naive and thinking you're going to win without effort, when the Republicans prove you otherwise each time, is stupid.

The biggest problem is going to come a LOT sooner than some future decision on abortion rights. Even if they can't ram a nomination through the Senate in 40-odd days (and the previous record was 50 days), the lopsided conservative balance of the present Court will hear all the inevitable suits that will surround the attempted GOP theft of the election. And I don't doubt for a minute that they will hand the election to Trump even if he loses both the popular vote AND the electoral vote.

The identity of the next president is gong to come down to the Joint Chiefs and whether they take their oaths to defend the Constitution more seriously than Trump and McConnell and their lackeys. It's either going to be that or eight months from now we'll be in a genuine civil war. And I'm too old now, and too arthritic, to do my part shooting Republicans.

OldRod: Graham went on record (more than once) back in 2016 that not confirming Garland was setting a precedent that he intended to uphold.  He even specifically mentioned if a Republican won in 2016 and a vacancy became available in the last year of his 1st term, that he would not fill it - which is the exact situation we have here


This is one of those things that he says because the political climate dictates that he says it.  It's completely empty words.  Or, as I read in a fortune cookie once, "Actions are louder than talks"

We all hope that he sticks to his word.  But his actions show that he never EVER sticks to his word.  So we cannot count on this.

No matter how the election goes, it will end up in front of the Supreme Court and Roberts is unreliable.

Republicans and Democrat's paths diverged years ago. They're two buses going in different directions to different destinations except the Republicans have hijacked the other bus and set it on fire.

No one person should have this much power. We've known this for as long as Mitch McConnell has been Senate Majority leader. The answer is probably ranked choice voting and a parliamentary system of government. Too much of our current government relies on gentleman's agreements and each of the three branches of government jealously guarding their power. We've seen what happens when a political party with no moral or ethical restraints captures more than one branch of government. We have no mechanism to enforce parity. We also rely on a free press to act as another check on governmental overreach and a politically active population to be involved. Well a good portion of the American populace can't be bothered and the press is compromised by mega corporate interests these days. American Democracy is teetering on the brink of extinction right now. It may already be too late to save it(although that doesn't mean we shouldn't try).

Some things are worth fighting for. Dying for. Freedom from oppression and tyranny is one of those things.

The left does seem to be playing by the old rules and hoping something will happen.  People aren't outraged by what the right is doing.  They're ok with it.  It's working and winning in their eyes.

I'm not sure what the next move should be.   And I hate the thought of the kind of change the Dems will have to demonstrate to prevail, but the old ways aren't cutting it any more.   It's adapt or die time, or at least adapt or let the right take us back to pre 1970 USA time.

I was so worried that the country was farked that I retired early on Jan 20, 2017. A big part of that was that I didn't want to have security clearances at the same time as Trump. I thought there would be purges, fascism, violence in the streets, and blatant criminality protected by McConnell.

People were surprised, because I was entering the cruising altitude part of my career: big salary, but useful for wisdom and mentoring as opposed to twelve hour days in the labs. I tried to remind them that my well-known super power at work was spotting big problems far in advance of others and trying to mitigate them, but they were confused about why I was leaving so much money on the table.

I sure hope some of them eventually got it, as this has been a very pleasant 3.5 years (except for the doom scrolling).

Don't lump everyone together. I think most of us know that you shiatheads are going to stay home again just like you did in 2016 and again in the primaries. There will be no senate flip, trump will win re-election, and his court picks will be cemented well enough they'll be there forever. Since you can't be counted on to vote, packing the courts would be a gigantic error as it's only a matter of time before republicans take over the government again and just fark us over worse. First off, if you think that nominating a conservative somehow is part of Trump's master plan, may I point out that he is an incompetent boob. He has no master plan, hell just look to how he's handled EVER crisis of his presidency.  Also, how is a 6 to 3 majority somehow MORE important than a 5 to 3 if the election hits the SCOTUS?

So stop freaking out. I fully expect Trump to appoint another justice because he is an idiot. I think McConnell will be forced to go ahead with it. But it's a penny wise/pound foolish plan, and it would only confirm that they know they wont win in November.
Otherwise, why put vulnerable senators like Collins under more heat? And it a bad plan because it will get all democrats on board with stacking the court. They will lose their majority in the SCOTUS. If they sat on the seat, or even nominated Merrick Garland, they might defuse any notion of stacking the court and hold onto their SCOTUS plundered seats

It will be unworkable chaos and the system will collapse. The only way out of the unjustness of this system is to tear it apart and start over. Roberts destroyed democracy with the Citizens United decision. Citizens United gave the United States to Russia (well, the highest bidder, which was Russia).


I don't disagree with you on that point. But, the decision itself wasn't a power grab by the court. That's about to change.

I thought it might be comforting to know that even the most recent guy took almost 3 months to confirm. People keep saying McConnell will have this done within a week, but the process definitely takes way longer than that, unless there's some special legislative power he's hiding up his sleeve.

I think McConnell can change any Senate rule by a simple majority vote. Much of the United States depended on politicians' honor.


Those "simple majority votes" can themselves take weeks to go through.

A lot of the work of the Senate goes by Unanimous Consent. If you do not agree to unanimous consent, you have to take a full vote of all 100 senators every time, which means among other things, that the 23 GOP senators up for election this year would basically be glued to their seats in Washington (compared to 12 Democratic senators) during the last month of their campaigns.

You could try to change the rules to require fewer full votes, but that would itself be subject to repeated full votes of the Senate.

If McConnell were smart, he'd require all members of the Judiciary committee back, but tell everyone else that there'd be no floor votes until after the election (but before the inauguration).

Won't happen because he's greedy.

And I am completely terrified that the absolute worst case scenario is about to unfold.

We will lose the court.  Trump will cheat.  They will side with him.
And our Democracy dies, just like that.

I hope to hell I'm wrong.  I really REALLY hope I'm wrong.

I was feeling dread about 6 weeks ago, and it lightened up about 2 weeks ago.

Now that feeling of dread is back and it's 100 fold worse than my initial feeling.

I honestly believe America is done and that sometime within the next 2 years (or less), my SSDI will be taken away, as well as my son's and mine SNAP benefits, and my son's Medicaid. We will be homeless before those 2 years are up & there won't be anyone who will help us, as all social safety nets will be dismantled. 

RBG passing is the absolute worst thing that could have happened right now.

I am scared beyond words.

Sorry about that.  That's horrifying.

Our only hope is that the SCOTUS does the right thing regardless of politics.

Actually, that's how it may work out.  And listen, the supreme court will matter less if we have the two houses and white house to write and sign progressive laws into place.  We already had the courts shoot down the voting rights act WITH RBG in it.  Now we can rewrite it and apply it to every state and the courts will have to figure out some other reason to shoot it down, but it will take time and in the meantime, it'll make supporession harder.  Smart with gay rights and voting laws, etc.

The game isn't lost.  We lost a valuable piece.  Our queen, if you will.  But other pieces, well placed, can still win the game.

this is the purpose of amendments.
overall the document isn't too bad, just ill-defined in some areas. The amendments, too.

It is worth remembering that a constitution serves the people, not the other way around.

I'm permanently disabled. My son is an adult with autism and unable to work full time. Even if he could, he's just been put on a "No work leave" status because of covid19 (he works for a school district).

All we can do is vote. I tried volunteer work when I first became disabled, as well as going back to school, as things to fill my time and learn even more about helping my son (I was going for a degree as a direct support professional) and sadly soon found out that my disability renders me unreliable because it's completely unpredictable. I can be ok today and wake up tomorrow unable to walk. I can become bedridden for weeks at a time if I twist in a poor way from taking a shower.

I'm useless except in keeping up with paperwork for my son and I. I am great at providing emotional support for others, but that's usually all I can do.

We vote in every election. But beyond that, we are unable to help. 😪
