Trump's only hope is everyone who supports him turns out. The best way to turn out evangelicals is to have that open seat in jeopardy.

They can get the best of both worlds by waiting until the election. If they win they can say they were being honorable and letting the people choose. If they lose they can pass a judge through a lame duck session and have avoided a lot of the fallout during the campaign

They can't guarantee the election win without having someone in that seat.

They have a 5-3 majority right now. 2 being Trump appointments, thomas having voted for bush v gore and roberts and alito having been appointed by the guy who won it.

They don't need the extra vote, and their other efforts to disrupt the election are more likely to swing it well before it gets to the SC.

No matter how the election goes, it will end up in front of the Supreme Court and Roberts is unreliable.


Even 4-4 just let's the lower court decision stand. And they've packed those courts.

This is a particularly specious argument. As the majority leader, he defines the way the GOP senate votes on issues. This is high power indeed in the US political system. In some ways far greater than the POTUS

Republicans told Obama they would support Garland, even going so far as to say, "Obama should nominate Garland, but he won't."  No one Obama picked was going to be approved, because the Senate Republicans were refusing to do their duty to advise and consent.  shiat, they could have voted Garland down and at least have a figleaf to cover for their abuse of power, but no, they couldn't do that, because Garland was praised repeatedly by them.

And I am completely terrified that the absolute worst case scenario is about to unfold.

We will lose the court.  Trump will cheat.  They will side with him.
And our Democracy dies, just like that.

McConnell knows they've lost the Senate.  His one goal throughout his past 20 years of service has been to pack the court.  At this point he doesn't give a crap about other Senators or Congressional elections, except his own, and he's solid.  All he wants is to pack the Supremes, and now at the 11th hour, he's got his chance.

1. Trump uses the open seat as a rallying cry. Evangelicals, who already vote in large numbers and are everywhere, vote in even greater numbers.

Does that mean you're agreeing with me that since it's 106 days until a new Congress & they delayed the Kavanaugh confirmation ny 90 days, if she had died a couple weeks later, they could have delayed it a similar amount of time?

Or does that mean you think they can delay it longer, like they did for Thomas, at 99 days, & that they'll be able to push that to 106 days?

Or... you're not suggesting that 90 days is less than 45 days, right?

I thought it might be comforting to know that even the most recent guy took almost 3 months to confirm. People keep saying McConnell will have this done within a week, but the process definitely takes way longer than that, unless there's some special legislative power he's hiding up his sleeve.

The guy was nominated, That's all the president gets to do.  It's very simple.

Obama could've easily sat down with Republicans, came up with a list and nominated somebody they'd actually confirm.

Doesn't matter.  The Republicans were never going to confirm anyone nominated by Obama after 2013.  They would have found some reason or other to refuse to consider the nominee, and if that meant having no Justice on the Court for 4 years, they would have done so.  We've been farked since the Republican took the Senate, it was just a matter of time to see how farked.

Two are on the record as not supporting a nomination this year. Need to find 2 more. Technically 1 more is enough for a 50/50 vote. I assume the VP would be the tie breaker? Wonder if there is a way to stop that???

I saw Murkowsky say that, who was the other one? As far as I know, the VP would be a tie breaker.

Another thread said Mitt Romney.. and a couple others.  Perhaps even Lindsey Graham.. which sounds like a long shot, but he may be desperate enough to keep his 'job'.

Gardner and Collins would probably defect out of self-preservation, too.

After the election, though? All bets are off. The Democrats would be wise to kidnap three or four Republican senators, stash them someplace safe and disconnected from the outside world, and then stay in their states until January 3rd.

If there are defectors, they will come from Romney, Murkowski (she's already said she won't vote for a nominee that is rammed through at this late date), Gardner, and who the fark knows about Collins.

One other nugget to keep in mind. Since Mark Kelly and McSally are a special election, the winner can be sworn in almost immediately. They don't have to wait until January.


I just threw some money his way this morning for that very reason.

They need the new RWNJ justice in place so the Supreme Court can rule on a contested election and crown Dolt45 as the new American king.

keldaria: Prediction: McConnell won't have the votes to confirm a nominee because vulnerable Republicans will reject the idea of hitting the blue voter hornets nest with a stick because they are already swarming enough as it is. That said, on November 4th after it doesn't matter, those votes will magically materialize regardless of the outcome because the senators will have either lost and go into lame duck mode or they will have won and go into "this is the will of the people" mode.


I don't know how this will pan out in the Senate, but I think Trump is definitely going to push for someone to be appointed before the election.  His priorities are to get any 'win' he thinks he can get, and to get another toady on the supreme court.  Look for upcoming editorials from potential nominees sucking up to Trump or advocating for "unitary executive theory".

EvilEgg: Yay, a new Justice picked by a President who got a minority of the vote and confirmed by Senators who Represent the minority of the voters to enshrine opinions antithetical to the majority of the country.

Stupid has won. I don't know what we can do about it.


Institute a purge of every Trump appointee and everyone they have ever hired and then prosecute every crime you can dig up. The Democrats are too farking weak to do it though.

Vote them out.

Romney, Collins, Murkowski, Graham and Grassley are on record saying they won't vote on a SCOTUS opening before the election.  Hold them to that or make them pay for it at the ballot box.
