EvilEgg: Yay, a new Justice picked by a President who got a minority of the vote and confirmed by Senators who Represent the minority of the voters to enshrine opinions antithetical to the majority of the country.

Stupid has won. I don't know what we can do about it.

Time to put out the moron traps,

She'll never do it, but that would be awesome!

She'd never do it because it wouldn't accomplish shiat. Good lord people. This is a Nancy Pelosi free conflict. If you need to use a bogeyman Democrat to signal to everyone that the do-nothing democrats are the real problem here, at least use Chuck Schumer. What in the world makes you think McConnell would even acknowledge anything going on in the house?

Actually that sort of parliamentary trickery could work. The objective wouldn't be to actually get someone removed, it would be to force the Senate to waste time on it.

Did the first impeachment proceedings stop the senate from seating judges? I was under the impression that nothing really has this whole time excepting the brief holds individual republicans have put on the process. Is there an actual rule or law that halts traffic through the senate while an impeachment is happening?

This is how it could play out

Courts are packed with indebted Trump appointees

Election is compromised and contested

Courts rule in favor of Trump

Country has Trump for another 4 years at least

So what are we going to do about it?

Expand the size of the SC and pack the court.

I would imagine any attempt to expand the size of the court would be challenged and eventually end up in front of the Supreme Court.  If Trump has a 3rd pick on there, there won't be an expansion

The size of the court has already changed through history. It just takes an act of Congress. There's no judicable controversy if Congress passes something and the President signs it.

Utter Genius: Republicans are so much better at politics than Democrats are.

You can crow about which side is more virtuous than the other, but in the end it doesn't matter. America belongs to the competent, and Republicans are more competent then Democrats.

[Fark user image image 850x400]

Don't worry. There's always the judicial filibuster. Oh wait no there isn't, lol.

Heh, you think the Republicans were going to let the filibuster remain if the Democrats hadn't removed it first?  You're so adorable.

Man look at that projection. "Yeah sure we're the ones who actually triggered the so-called 'nuclear option', but Republicans would have done the same (even though they had the opportunity and didn't)." I'm also sure that right now in 2020 with a real possibility of losing both the senate and the presidency they'd be very eager to undermine their possible position as the minority party.

Well, the important thing here is to accept no blame and learn nothing going forward, like the people in these threads fantasizing about farking the goat further by packing the court.

There may be another option too - doesn't the government run out of funding at the end of the month?  What happens if Pelosi refuses to work on a funding bill?  Would that slow things down?

I forgot about the government shutdown. I have no idea how that would work. I'm fine with the idea of closing it all down until after the Election if that would stop it. Pandemic be damned, nothing useful is being done to address that anyway.

Obama could've easily sat down with Republicans, came up with a list and nominated somebody they'd actually confirm.

He did.

They told him they'd be willing to confirm Merrick Garland because he was still a conservative jurist, if not quite as ignorant and blindly partisan as Scalia, so that's who he nominated.

Then they refused to give Garland a vote.

It is gonna be so hard to learn the names of all thirteen Supreme Court Justices next summer.

Seriously that is what needs to happen.  They push in their guy fine.  We get the Senate we need to point out the hypocrisy of what they did after Garlan, then expand the court to thirteen judges and then double the number of Federal judgeships and fill all of those.

The last needs to happen regardless because the  case load.

You have to understand how the "conservative" mind works. Because the present refuses to conform to their distorted imaginings of some halcyon distant past we should be returning to, they mentally rewrite the past to conform to their convoluted and twisted narrative.
Facts such as you just stated, they simply edit out.

No.

The US government works through a series of "gentlemens' agreements." If people decide to do other things, in many instances there are not actual laws to stop them. And even if there were, when the Justice Dept is ruled by someone like Trump, they can simply decide to not prosecute.

Don't be. Your first priority is to live your own life, take care of yourself, and thus maintain your potential capacity to help others. Make the right moral choices on a daily basis, participate in your society, send money, vote.
It may be that America made a mistake back in 2016 that it won't recover from without a hefty and painful price to be paid.
Life is like that sometimes - you f**k up, and it costs you, and all you can do is pay.
Hopefully, America will learn something.
Be be brave, be of good cheer, and purchase lots of guns and ammo.

The biggest problem is going to come a LOT sooner than some future decision on abortion rights. Even if they can't ram a nomination through the Senate in 40-odd days (and the previous record was 50 days), the lopsided conservative balance of the present Court will hear all the inevitable suits that will surround the attempted GOP theft of the election. And I don't doubt for a minute that they will hand the election to Trump even if he loses both the popular vote AND the electoral vote.

The identity of the next president is gong to come down to the Joint Chiefs and whether they take their oaths to defend the Constitution more seriously than Trump and McConnell and their lackeys. It's either going to be that or eight months from now we'll be in a genuine civil war. And I'm too old now, and too arthritic, to do my part shooting Republicans.

LurkLongAndProsper: DarkSoulNoHope: Farkin_Crazy: Professor Duck: andrewagill: [Fark user image image 425x444]

It's 106 days until a new Congress.

They won't be able to delay it that long but they will be able to delay it past the election in 45 days.

If she had died a couple weeks later I'd have said it was too late.

Ginsburg's seat will be filled by Friday.

Announce pick Monday
Have "hearings" Wednesday
Vote to finish hearings Thursday
Vote to confirm Friday, with all The voting yes because of course they will.

If this all plays out like that, the Senate will easily turn blue. Voters will make the GOP pay for their hypocrisy.

And the court will be expanded. Quickly.

This is why I don't like Conservative/Centrist Democrats like you, because you all are stupid and naive!

You think that because you nominated a woman in 2016, automatically you would have a win, no matter how much Hillary was perceived to be unlikable and ran a weak campaign. Now you're assuming that once the Republicans and Mitch McConnell act on their hypocrisy, which was predicted when they blocked Merrick Garland, you'll automatically have the Senate switched to the Democrats and be able to stack the Federal Courts with Biden appointees (having these thoughts when Biden isn't even elected yet)! Stop living in fantasyland and start actually working to win elections, stop assuming you'll automatically win as the "lesser evil"!

Don't lump everyone together. I think most of us know that you shiatheads are going to stay home again just like you did in 2016 and again in the primaries. There will be no senate flip, trump will win re-election, and his court picks will be cemented well enough they'll be there forever. Since you can't be counted on to vote, packing the courts would be a gigantic error as it's only a matter of time before republicans take over the government again and just fark us over worse. Congratulations, this must be a major win for progressivism.

It is a major win for progressivism, it proves that Centrist/Conservative Democrats running milquetoast candidates whom don't upset their wealthy donors allows fascism to take hold. Of course you blame progressives for "not voting" when twice there has been a conjoined effort to prevent progressives from winning candidates (especially Sanders), as well as Republicans suppressing the vote in historical Democratic areas (mainly cities) of Republican states, and then you use those constructive suppression to "prove" that progressives can't get out the vote. Also, you completely ignore the non-voter as a factor, which you can fix by making election day a state holiday in Democratic states so people can vote who had no ability before due to work schedule or other factors, as well as putting out political candidates who can convince people to vote for them with promoting good government ideas and policies!

Of course proving progressivism should have been pushed for instead of Conservative Democrats' "middle ground ideas, but settle for the Republican plan as a 'compromise' " is only a "I told you so". Still being naive and thinking you're going to win without effort, when the Republicans prove you otherwise each time, is stupid.

RBG is solely to blame for this.

She could have left under Obama a decade ago and he could have picked her replacement easily. But she was so sure Clinton would prevail that she hung on despite being at the edge of death because she wanted a successor who was handpicked by the first female Pres. Now control over your gynecological apparati is going to vanish.

I expected Turtle to jump on this opportunity first chance.

Now we get to see more liberal handwringing as we get the partiest bro who ever partied confirmed within 6 weeks, or we get some underqualified young chippie just to throw a bone to feminism sort of like how Old Bush and Biden saluted Civil rights by replacing Marshall with a much inferior (but darker skinned!) First of all there isn't enough time for another impeachment. Second, what has changed that you think it's going to work this time? He'd be exonerated again and he'll get to play the victim a second time.

Delaying a confirmation and failing to convict is a win. Jesus christ. How difficult is it for you guys to understand that?

Not giving the gop another seat is the point.

There's nothing that says the president can't still nominate a judge while being impeached.

Alphax: danvon: MindStalker: danvon: The only way to prevent this is to find four Republican senators who are capable of being shamed.

You can stop laughing now.

Two are on the record as not supporting a nomination this year. Need to find 2 more. Technically 1 more is enough for a 50/50 vote. I assume the VP would be the tie breaker? Wonder if there is a way to stop that???

I saw Murkowsky say that, who was the other one? As far as I know, the VP would be a tie breaker.

Another thread said Mitt Romney.. and a couple others.  Perhaps even Lindsey Graham.. which sounds like a long shot, but he may be desperate enough to keep his 'job'.

Lindsey Graham has been compromised ever since he went golfing with Trump. He went from somewhat moderate R for some issues to raging sycophant in a day.

Opacity: They'll wait until the Wednesday after the election- then the lame duck Senate and lame duck president will vote in the most inane, backwards hick you've ever seen. If you think justice keg stand was a tragedy, just wait and see what they put on the bench.

The only hope is some procedural moves by the democrats to stall until Jan 21, assuming Trump loses.

There are no procedural moves that will prevail.

Remember how everyone here was saying Obama should have just made a recess appointment?

If it looks like this isn't going to sail through Mitch will simply call for a recess, Trump will make a recess appointment, declare it permanent, Democrats will say you can't do that, it'll go to SCOTUS, and his pet court will uphold it.

The Democrats in the Senate should put up a fight because it's the last thing they'll ever do that even looks like it'll matter, but they've already lost.

Your answer was from quora. Random guy on the street. How is baby fromed?

You think the 23 gop senators up for election want to push through another kavanaugh while trumps crimes are laid bare?

But you guys aren't gonna do that. You have your excuse. "Sorry, can't do anything"
