It remains unclear whether Republicans would have the votes to make a new appointment before Nov. 3.

Oh they'll have the votes. The entire election hinges on prematurely declaring Trump the winner. They'll call all The Families in for every Favor.

Wouldn't holding on to the pick after the election make more sense?  If they fill the spot now, that would energize the left and really do nothing for turning out their own voters.  If they wait, that might even convince some of these Lincoln Project and Never Trumpers to turn out and vote for him.  Worst case scenario for them and the Dems sweep the House, Senate, and White House, they can still ram their pick I'm calling Brett Kavanaugh 2:Rapier Doosh Bro through during the lame duck session.

I don't think they will, though, as Yertle and Fat Turd have the guile and cunning of a wet sponge.

They would be smart to wait until after the election. There may be a few R senators that would be hesitant to rubber stamp some Trump lunatic with an election in six weeks.

After the election it won't matter. Either they won and are in for another six years, or they lost and they're out and they'll be happy to burn the place down on the way out.

See:  Dems need to pack the Supreme Court thread.

The Presidency is favored for Biden, the Senate could go either way.

Give to Senate battleground states and we could see this:

2 states added (DC and Puerto Rico), so 4 more democratic senate seats.   Plus the GOP having another brutal election there in 2022 when they are defending more than twice as many seats.

And then move the number of SCOTUS justices to match the number of US circuit courts, which is 13.   That rationale has been used a couple of times in the past to change the number of justices.

The election has already started.  People are voting in some states already.

A presidential election really only has a 4 or 8 year effect. The Supreme Court appointment last an entire generation. Don't think that Mitch McConnell hasn't already done the math on this and decided that Trump is on his way out anyway.

The GOP isn't concerned with good governance , they are and they will always be about enriching themselves at your expense.

There are single issue voters for Trump. He gets another anti abortion vote on the SCOTUS, they may feel that he has nothing more to offer them. They might just stay home.

On the other hand, some might be more energized to vote.

We'll know for sure in six weeks or so.

Gardner and Collins would probably defect out of self-preservation, too.

After the election, though? All bets are off. The Democrats would be wise to kidnap three or four Republican senators, stash them someplace safe and disconnected from the outside world, and then stay in their states until January 3rd.

Fark that. Merrick Garland was a sensible moderate, an olive branch to the Republicans saying "we're not going to replace Scalia with a total liberal." They didn't take the olive branch then, they shouldn't get it now. If Ginsburg gets replaced with a boring-ass swing-vote moderate, it will be a disgrace.
