The worst part of all this is that he can't (legally) waive it, but he *might* be able to delay it.  Then it turns into a bigly tax hike later, in addition to doing nothing substantial for the people most hit by this.

Unfortunately, it turns out a president can pretty much do whatever the fark they want when the senate majority leader, attorney general and the majority of the supreme court are all complicit.

He does not have that power.  Only congress does.  That's pretty explicit in the constitution.  He can delay the collection, but all that would do is make things hella confusing.

Basically you can go 'you can collect no payroll taxes for the next 3 months' but then 3 months from now, you'd need to play catch-up and collect 3 months worth all at once.

It's just all sorts of stupid.

Dear god, please don't let him f*ck up payroll. We reopened May 11th, and things have been running pretty smoothly. I don't need this sh*t.
No matter what happens, I will tell my payroll company to continue collecting payroll taxes, or I'll store it in a separate bank account until life returns to normal.

Yeah, the article did. He can defer the deadline for payroll tax payments from employers, but it would take congressional action to forgive those deferments. Other wise employers would have to eventually make those payments, and without some kind of assurance that congress would, in fact, pass a bill forgiving those deferred payments that money is just going to sit in a bank account accruing interest.

Yup yup yup.  Anyone who actually benefits from this would be wise to just set all that difference aside for when the bill comes due (which will probably be after the election but before the inauguration, so it'll still hurt people but Fox can blame Biden).

No matter what happens, I will tell my payroll company to continue collecting payroll taxes, or I'll store it in a separate bank account until life returns to normal.


All Trump can lawfully do by executive order is delay payment deadlines for payroll taxes, and promise to sign a bill forgiving them if one passes Congress. But when both parties oppose payroll tax cuts as they do now, it is very improbable such a bill will be forthcoming.

So you'll be doing exactly what you should be doing, and what most businesses are going to do if Trump "cuts" payroll taxes by delaying their payment deadlines. Which means Trump's executive payroll tax "cuts" will have  no stimulative effect on the economy.

More important, Trump can also give the payroll tax cut to companies so that they get at least as much benefit as to voters. The trick for him is to get another corporate tax cut in there.

That's exactly the plan. Then it forces Democrats to pass a bill to forgive the debt, effectively eliminating the Payroll Tax entirely, so that people don't have a sudden massive tax bill.

It's also why the WH had no intention of negotiating in good faith with Congress. They just figured if they don't get the exact deal they want, they can just EO it into place anyway.

Obama was all about the payroll tax, too.  He wasted a lot of political capital enacting it and I didn't even notice it in my paycheck.
