If someone has deferred status and ICE comes around to pick them up to deport them, they are doing so without legal authority.

It'd be interesting to see a Dreamer to use a stand your ground defense for gunning down federal agents who were effectively trying to kidnap him.

How hes going to enforce it?

By DHS losing every appeal for every deportation and potentially seeing illegal acting secretary charged with criminal contempt. loss of legal protection for DHS employees who are now operating outside the law.

/dunno who would charge Chad with criminal contempt with this DOJ.

Are we having a constitutional crisis yet?

2020-07-29 4:08:48 PM
For three years we've had concrete evidence of people breaking laws over and over, and yet nothing happens. So, what's left for the american public? I mean, do we start dragging congress critters and officials in to the street and beating them within an inch of their lives right in front of their families?

Does not need to be criminal contempt, it could be civil contempt with Chad holding the key to his own jail cell. The judge could also start locking up any of the DHS attorneys that show up on the same basis.

So every appeal being pursued in court by the president can be immediately dismissed purely because they're acting in bad faith right? Right?

Are there certain things you can't do if you're only an acting director of a department, or is it anything goes? If it's the latter, why bother confirming anyone at all?

/Sick and tired of all these "acting" directors in Trump's admin.

There are. And there are limits to how long they can be acting. They'll get right on with enforcing that though.

You'd have to find a way to prevent them from participating in government. Now that they legislate via Zoom and Skype, that's really impossible. You could beat them up so they can't enter the legislature for a few weeks, but you can't stop them from governing anymore.

Trump defies the SCOTUS? Really, who did not see this coming after 3 November 2016?

We had the lawful chance to remove Trump from office by impeachment and conviction previously. Senate Republicans, with the exception of Mitt Romney, voted to keep the guilty Trump in power.

What happens after 3 November 2020 when Trump loses the election? Based on Trump's previous actions, Trump will not leave office, IMHO. Trump will claim the elections in all US counties, parishes, territories and states were fraudulent, or in certain key areas. I would even expect Trump might even try to swear himself into a second term at noon, 20 January 2021.

/I really hope I am wrong.

I would certainly like to see that, but I wouldn't recommend trying, because you'd need to survive the encounter to get to the courtroom.

Pretty sure the whole point of the Trump presidency was to destroy all checks and balances over the executive.

He's already decided Congress will do nothing except approve his judges. And now he doesn't even need to obey judges.

Pretty sure that is congress' job.

Yep, not a single republican cares about law or order.  They all want to suck on trump's mushroom.

barr will do nothing, because he think the SCOTUS is a joke.
republicans will do nothing because they love putin and raping little boys.
Democrats tried, but ALL republicans hate America.  Particularly that pirate motherf*cker who poked himself in the eye to get out of latrine duty and get elected by his 3rd world district.

Do you suppose the Supreme can declare a government official -- including the President -- in contempt of the Supreme Court? I've been digging around a little and I can't tell if that has ever happened. Separation of powers and all that, but no president has ever gone this far, either. Ordinarily, a president openly and publicly defying a SC decision would lead to impeachment because it would put the president in flagrant of his oath of office. But the Republican-controlled Senate doesn't give a fark about that. And there isn't enough time left before the election, anyway.

I dont see him defying the supreme court.. he is defying a lower courts decision to restore parts of the program created by the executive branch.. DACA is not a law.

Remember, the supreme court said nothing repealing the program.. only that the administration didnt follow procedure.

The Supreme Court wouldn't. The district court judge they keep blowing off would be the one holding people in contempt.

The judge probably couldn't do anything other than wag his finger at Trump himself, but various other DHS officials could be arrested and held.
