Ironically enough, if we had single payer healthcare the hospital couldn't have fired her because it would have been a violation of her first amendment rights. When working for private a hospital, that consideration does not apply.

Single payer doesn't imply that every hospital is government run. You're thinking of a nationalized health care system, which is a subset of possible single payer systems. Canada is a single-payer system, but most providers are not government run.

In the video, which was posted online by TAPInto Nutley, Pastore extends her arms and waves at the protesters. It's a gesture that Tripodi says shows his client "very clearly waving."

Unfortunately for Ms. Pastore, New Jersey is an at-will employment state.  So if her employer wants to fire her for bogus reasons, they can do that.  If they want to change their reason to firing her for waving good-bye, they can do that.  And if they want to fire her for no reason at all, they can do that too.

It'd be a shame if Ms. Pastore was a conservative voter who voted for Republicans who passed at will employment laws in her state.  Because that means she would've voted herself out of a job, with no recourse whatsoever!

Yeah.  That'd be just such, such an awful shame.

Yeah, that's an unfortunate angle. The video shows she's shooing away the protesters, but the still captures that at a truly inopportune (for her) moment.

At any rate, I can't get too worked up about someone who is counterprotesting a plea for racial equality. The fact that she's on that side of the barrier is quite sufficient to let me know what she holds dear, and it's unfortunately diametrically opposed to what I do. 'Unfortunate' because equality is something that I would hope every American wanted.

Watch the video. She wasn't doing the salute. She was pointing and doing a flippy hand thing. I've seen 1,000 middle aged white women do the exact same gesture.

The video shows her from the side and shows that she was shooing away the protesters. Still, at-will employment results in such things. And I agree with edmo. Her supervisor(s) probably was/were itching for a good reason to drop her.

I work in the employment field. You're still protected against things like being fired for political beliefs, even in an at will state, which is what I assume their charge will actually be.

In the end, she'll get a nuisance payout because that's what's best for the bottom line and every one will go about their day

Why do you expect consistency from such people?  It's all 'STATES RIGHTS!  STATE RIGHTS!'.  When the feds try to protect the constitutionally recognized rights of minorities , but 'SEND IN THE FEDERAL EINSATZKOMMANDOS!'when 'those people' start getting uppity/protesty.

Just sit back and enjoy watching a Trumpanzee get hoisted with her own petard.

She is actually waving, though. It's obvious if you watch the video that arm up, dismissive little "Buh-bye" wave. She's not holding her arm still in that pose, and at one point does that same 'shoo!' wave with both hands.

Who knows what else she has against her, but I sure as shiat wouldn't fire her from just that video, there may actually be a lawsuit in there somewhere. I wouldn't risk it.

I think or at least hope that you're right.  The video seems to show her holding her arm(s) up at various times and making a flapping shooing motion with her hands that I could see in the right still shot looking like a Nazi salute.  I'm a bit on the fence about this one with what's shown so far.

I didn't see anything nearly as obvious as Laura Ingraham's sieg-heil-whoops-wave moment. She was mostly just trying to shoo the protesters off. I mean, that video may have edited the sieg heil out, for all I know, but a still picture of her shooing motions could have easily looked like a sieg heil when it clearly wasn't.

So, she may be an ignorant racist piece of human waste, but I don't think Nazi salutes are engraved in her muscle memory like they are in Laura Ingraham's.

Watch the video though.  She is actually making that shooing motion with her hands.  I'm not interested in crucifying someone over something that they didn't actually do.  I'd like to see other video that shows her actually saluting vs. just that still shot.
