A) Why is this a politics link?

B) In a 2015 interview with The Washington Post, McCaulay said he had spent more than $20,000 on trademarks applications and considered it a "high-risk investment."It's not an investment at all, you farking halfwit. Are you demonstrating any actual use of those trademarks? No? Get ready for an ass-kicking in court.

Maybe, but he is willing to sell.  Buying is usually cheaper and easier than suing.  $100,000 isn't that much in lawyer fees.

On the one side, because team formerly known as the Redskins is changing their name over the racist associations, in a time when racism is considered a significant political issue.

On the other side, because trademark and other intellectual property "squatters" are rent-seekers who some consider to be taking advantage of the current system of federal laws and regulations implementing the Constitution's granting Congress authority of "securing for limited times to authors and inventors the exclusive right to their respective writings and discoveries", in ways such that those actions of the "squatters" do not "promote the progress of science and useful arts", and arguably inhibit it; hence, raising the question of the optimal regulations for such promotion, which itself also is a political issue.

Ergo, politics tab.

Why are you giving the reason for patents to defend trademarks?

\ VERY different things.

One person likened him to "Costco toilet paper hoarders during the pandemic." Another said he should be banned from the team's games, and another offered to punch him. He was called a jerk, a worthless troll, a gold digger, a self-serving liberal and a variety of expletives.

Who would have guessed that fans of such a "manly" sport could be such emotional pussies?

Jesus, people are acting like this is something new. It's just like domain squatting. Now, suddenly everyone has their panties in a bunch? It's a shiatty practice that's gone on a long time. Maybe the team needs to look at the ones he's trademarked and come up with an alternative? Then he doesn't get their money and they still get a new name. Show some farking creativity, this guy hasn't cornered the market on that.

They could even be the Washington We Don't Pay Trademark Trolls. It doesn't exactly roll off the toungue, but it gets the point across.

I hereby demand that I be given a Fark account: Why are you giving the reason for patents to defend trademarks?

Fair point; I suppose the basis for the trademark side of intellectual property law is grounded more in the power to regulate commerce with foreign nations, and among the several states, and with the Indian tribes. Nevertheless, my basic thesis remains sound; the boundaries of intellectual property of all sorts is a live political controversy.

2020-07-16 11:20:42 AM
He considered it a "high risk investment."

There was definitely profit motive in there, not altruism to protect the team's integrity. He knew this day was coming (we all did, right?). It's only because people found out who he is and sending hate his way that he's offering to be generous. If it was some anonymous squatter sitting on the names, there would be the expectation of a large payout.

Mikey1969: Then he doesn't get their money and they still get a new name.

I actually accept his explanation, that he wanted to protect the names from other people who'd look to profit from squatting on the trademarks. Per TFA, at one point he offered to give them a name for free: "He said this week, though, that if the team wants to pursue a name he has laid claim to, he would be willing to hand it over at no cost."

Near the end of the article, he also admits that he's sold 10 shirts in 6 years and understands that would be "a weak defense" if he were challenged in court.

Hah.

That guy should understand that trademarks you lay claim to but don't actually use are easy pickings. They're considered abandoned. Especially when you've been quoted as purposefully having "hoarded all the good names."

The Washington football team's on-staff lawyers should be able to handle that easily. Enjoy trying to argue that you really were intending on starting a few dozen football teams.

Wow this guy has been at this way too long... I looked into trademark applications when the story broke a few days ago and found maybe fifteen recent applications.

As for use, all it takes is printing the name on some shirts and putting them up for sale. As some others have said, it's weak, but the cost to pay him vs sue him are likely worth it.

There's only two tabs anymore, Main and Politics... everything in between are like the exits on the highway for grandma's, the mall, the state prison, the exit they added after they were all added so it ends in "B"... they're all points between the two big interchanges that you might hit if you really get desperate or want something really specific, but, most of the time its one to the other.

Isn't that the scaffolding that props up the entire system of protected marks/inventions/works?

Anyway, Snyder's been resisting a name change since he bought the team (in like 2005, he told USA Today "we're never changing the name, and you can print that in all caps: NEVER"). Forward-thinking people foresaw that the team's name would need to change eventually, and positioned themselves to make a buck off of a publicly-known "market trend".

// whether or not that's an abuse of the trademarking system is up for debate
// but I think Snyder should be forced to pay for one of those names just for being so blinkered and assholey about it

Washington Metro/Metros is a fitting name. It sucks, it often breaks down, it's inefficient, some part of it is always out of service and out for repairs, sometimes it's on fire but never in a good way. That sounds like a DC NFL team.
