It seems like the state shouldn't be in the life ending business to me for a lot of reasons.  I like the idea of the state stripping of any legal protection such that assault or murder committed against that person isn't a crime. Leave it up to the community to decide what happens.

That was a common early medieval punishment: to make someone an outlaw, who no longer enjoyed the protection of the king's peace. We stopped doing that because yeah turns out sentencing people to be hunted down like a dog and then tortured and murdered by sadistic lynch mobs is maybe not the ideal form of justice.
