That's the point, for sure.  Presumably his legal bills are being covered. So this specific fight is free, why not?

They want to get him past November so the pardon isn't an election issue. He wants to spend as little time incarcerated as possible.

I think Stone is as close to a friend as Trump has, who is wrapped up in a prosecution at the moment. Plus he's popular with the stigginit base.

Will be shocked if he dies more than a few months.

Judge Rao will definitely agree that you cannot require a convicted criminal to go to jail if the Trump administration tells the judge not to send them even while they refuse to use the pardon power.

He's been bouncing around Infowars and OAN begging for a pardon by playing the covid in prison card and saying he'd be a vital cog for a reelection campaign. Also said twice he's praying to Trump. He's freaking out.

I prefer going to prison in the fall, your honor.  The leaves are turning.  The ride there will be nicer.  I would like to think the warden will have had plenty of time to prepare my accommodations.  The fall menu in the prison restaurant will be updated with locally procurred produce.  Yes.  Fall would be good. Though we're getting close to Christmas and the grandkids...    Say.  Next January.  The prison is winding down from the New Year parties....

I respectfully disagree. Prison is never going to be safer than not prison. He has already received one extension and prisons have had enough time to get their pandemic procedures in place. Send him in and let justice be done to him.

/by justice I mean his actual sentence and nothing more.

Political corruption is a worse crime than most violent criminals ever commit. It spreads death and destruction and destroys countries. I'm against the death penalty for violent crime yet fully in favor of using it as the punishment for political corruption.

Oh, this one is easy... If Roger Stone's ally in the White House feels that the 'rona is important enough to make a national mask mandate, maybe order another quarantine, then Stone might have a chance. But if it's a "hoax" that's "just going to go away", then he's SOL.

Now that I think about it, I'd pay money to hear the judge say "Mr Stone, I place great faith in the leadership of our nation, and if they felt that the virus was dangerous enough to keep prisoners out of jail, I'm sure they would have said so by now. It appears that they haven't, so, motion denied."

He also probably understands that if he ever actually enters prison he's going to die there so what's a few more days if you are already dead?

That's fine in theory.  But one of the things he was convicted of was a death threat against a witness for the prosecution. So under the case law, in my circuit at least, that qualifies as a crime of violence.

And, at any rate, I'll simply hold him to his own principles.  If he was opposed to sending "non-violent" felons to prison, then I'll agree he doesn't have to go in, any more than any other "non-violent" felon.

But if he was happy to send plenty of people to prison, including those who simply disagreed with him politically, then I'm less inclined to make exceptions in his case.
