He used a loophole in the Constitution that gives Senate Majority Leader enormous power over all three branches of the government.  We've long understood that "advice and consent" means "of the Senate", but McConnell decided it meant "of Mitch McConnell".

I've often wondered what would have happened if Obama would have said, "You know what, Merrick? Fark it.  Just put on the robe and take your seat over in the Supreme Court building."  Would the Senate have had the power to drag Garland out of there?  Would they have?

Sure, it might not have set a great precedent, but the Senate choosing to refuse to give advice and consent is still a choice (thanks, Rush), and that wasn't a great precedent, either.

There's no need to get rid of the filibuster. A Dem president can merely declare a state of emergency, for any reason he wants, and reprogram billons of dollars from the pentagon for anything.

I for one look forward to women getting free solar panels for their homes with every abortion.

The Dems would be idiots not to get rid of it after the GOP abused it to cut Obama off at the knees in 2008-10. It would be an open admission that we'll never see any major reforms in this country unless there's an incredibly rare 20 seat majority in the Senate and that even then you'll only get the version of that reform that appeals to the most moderate member of that majority, as happened with the ACA.

So naturally I expect Schumer to keep it in place and give us a load of horseshiat about what a valuable tradition for compromise and debate it is.

I was listening to a news story the other day stating unequivocably that Joe Manchin and some other Dems are against ending the filibuster. One can certainly start to speculate as to why. My personal theory is that their owners (corporate donors) like the filibuster because it prevents new legislation that might slightly diminish their power from passing. It also prevents judges who have even a slightly skeptical position towards corporate from being confirmed. The focus on social issues often hides just how pro-corporate even most of the "liberal" judges are.

Right, that's why the GOP managed to pass exactly one law (designed specifically to bypass a filibuster) between 2017 and 2019.

Annoying as it can be, the filibuster is one of the few things that's kept the US from becoming just another banana republic. In today's environment, give either party both houses + the WH & no filibuster, and that will be it for anyone but the majority party until the whole system is broken and the US flies apart like a broken flywheel. Careful what you wish for.
