It's extraordinary, and it will not survive review.  Courts do not like prior restraints on lawful speech, at all.

I saw a different article that suggested that Mary Trump and some others contested the will on the grounds that other members of the family had a role in Fred Trumps death (indirectly). I suspect she got a lump sum of money from the estate in exchange for signing the NDA and dropping the complaint. Doesn't take much forethought to make the NDA is broad as you can get away with.

I still don't think that is grounds for an injunction against speech. The speech itself shouldn't be stopped, they just should just be potentially liable under civil proceedings.

This I don't possibly see how a court could issue an injunction on speech over a contract dispute. The remedy is a civil suit not prior restraint.

It's extraordinary, and it will not survive review.  Courts do not like prior restraints on lawful speech, at all.


Especially since this is a civil case between two private parties.  The remedy for violating the NDA is a financial penalty.  Not a jail term.

It also seems like an unfair contract.  You are withholding someones inheritance to force them to sign something?  Something the lawyers cooked up with the survivors not something willed by Fred Trump.

1.) What can Mary Trump say that would shock anyone, especially after this week? The Trump family could be the model for The Aristocrats and I don't think it will change anything, especially after this week with all of D2S's treasony behavior coming out. Unless he has an Oedipal complex, I don't think much changes.

2. Isn't an NDA something for a civil court? If she violates it, doesn't she have to refund money from a trust or something? I don't understand how an NDA would keep her from publishing her book, but then I'm not a lawyer. Any help here?

I guarantee you she didn't put every little tiny thing she knows into a single book. Whet everybody's appetite now. When it's all said and done write a tell-all and start throwing in the tidbits about the incest and the torture and the Mind Games and the pegging and the corruption and God knows what else those people were doing. The NDA would be void if the accusation is that the role in death is criminal.  This will be interesting

The book is literally on it's third printing with a release date in 3 weeks. Not quite as close as Bolton was but review copies of the book are out there for sure.
