How the Officers Charged in George Floyd's Death Could Get Their Jobs Back

With no police force to go back to?

2020-06-27 6:47:36 PM
"They were fired without due process," wrote Lt. Bob Kroll, of the Minneapolis Police Federation.

from the Minnesota Dept of Labor and Industry:
Employment termination
Minnesota is an employment "at will" state. An employee can quit for any reason; an employer can fire any employee for any reason as long as that reason is not illegal, such as discrimination based on race, creed, color, sex, national origin, ancestry, religion, age, disability, sexual orientation or marital status.

Union contract though.

To be fair, they were probably fired properly within the requirements of that termination process as well.

Philadelphia was forced to re-hire officers that were caught ransacking convenience stores.

Arbitration is the problem.

No this is a different union that benefits authoritarian ideals and control. It strips power from the people and puts it in the hands of rulers.

We always get caught up in the details, and nothing changes.  This november we will win the white house, the senate and the House.  We will defund the police and support social programs.  We will end this nightmare

Here's why that won't happen: your city will burn to the farking ground and these four will need something on the level of federal witness protection to outlive a mayfly.

Lol, Trump is a shoe in. Just like last time. Look at the parallels. Every single thing is playing into what got him elected originally.

Perhaps the arbitrators shouldn't get their jobs back.  Did the dead victims sign away their rights to a court process and opt for arbitration, too?   Outsourcing justice doesn't work.

Maybe the CDC needs to list Arbitration as a leading cause of death among black males.  An outfit that figures so much in so much death may be a criminal organization.

If you're limiting the scope to BLM, then maybe I'd agree.

Difficulty: ISIS boost is gone, CoVid-19

Well that's simple and naive.

Union.  An organization that has contracts with employers with, among other things, well defined termination processes and requirements.

Besides, relax.  These guys will get convicted, become felons, and then they can't be cops and fark their union.

You are putting names to things that doesn't matter. It's division and bigotry theat got him elected. The police brutality, covid, and trade platform split and pure distain from both sides fuels him and his voters.

I almost hope they do get reinstated, because that might be the only thing which could drive the outrage up to such a fever pitch that some kind of federal-level laws get passed.

Are you kidding? If they can't get a job in a police force Trump will hire them to work security at Mar-a-Lago. You want federal laws passed you'd better vote in November, even if Yellowstone is erupting and there are tornadoes full of zombie alligators.

Depending how long that conviction takes to get, that could be a couple YEARS of back pay, so ya, they will be fighting this.

this will never happen, thankfully.   How do you pay for social programs, smarty pants? Who's gonna take down your report when someone dents your Prius?   You can't win because not enough of you do anything but suck the milk from the rest of us.

If you live in that city you had better get a bug out bag prepared for you and your entire family. Because if they are reinstated there is a damned good chance that the ensuing riots will make the Rodney King riots look like a Sunday pic nic.

Defunding the polices not mean doing away with the police. It means over time reducing the amount of money that the police get and using that money to fund social programs. That is how you pay for the social programs. And there will still be police around to take down your reports. It is not rocket science. Well, then again, for some people it is as complicated as rocket science. If you like I can tell you what this means one more time and i will just use small words so you will not hurt your brain.

Marcus Aurelius: dv-ous: Union contract though.

An arbitrator is a third party that listens to both sides in a dispute, and then decides in favor of whoever is paying their bill.  In this case it's the police union.

At least in my state, public sector employment disputes are settled by the state labor department. Arbitration panels include one labor, one management, and one neutral member. While 2-1 rulings are common, the 3-0 rulings are clear indicators that one side is absolutely right.  It's not some random arbitrator that one side hires and then rules for "whoever pays the bill."  There is a nominal filing cost but it's quite low, especially given that the board provides free mediation services prior to arbitration.

But that's my state, and I don't live in Minnesota. Maybe they have some asinine system where the party goes and hires a hand-picked arbitrator...wait, no, their system seems to be a lot like my state's: https://mn.gov/bms/arbitration/
Looks like you're just making stuff up.

They will get a trial first. If they get their badges back before that...there will be riots. That is damn near a certainly.

I can't predict what the trial results will be. But there will be a trial.

But for true justice there should be variations in sentencing. The guy with his knee in Floyd's neck, and hands in pocket should go away for a long time. The others, I can't say. I'm not the judge or the jury, at least not yet.

My way out of jury selection would be that I feel for a couple of those guys speaking up to that asshole on the neck. They were rookies. One had been on the force for a couple of weeks, the other just started his fourth day.

There's definitely a hierarchy in most professions. Especially police. Rookies do not tell senior ranks what to do.

But that is what a trial is for and will do. The Police Federation will not have a say.

Unfortunately, if there is a written contract then that would also be legally binding and would supersede the basic employment protections.

If you and your employer sign a contract stating the only reason for being sacked was, for example, sexual misconduct then you could not be sacked for any other reason without breaking your contract of employment.

Since 2006, eight Minneapolis police firings have been decided by arbitrators and all but two resulted in the officers getting their jobs back, according to an NBC News review of records from the Minnesota Bureau of Mediation Services.

So either the Minneapolis police are being unfairly targeted, or the Minneapolis city government is a doormat.  Or both, but since the Minneapolis city government is run by Democrats, I'd say it leans toward the latter.

Which the mayor and police chief knew was likely when they went through the charade of firing them. They knew that they'd likely be forced to rehire them with full back pay (if of course the officers are not convicted felons, which is extremely unlikely: see Freddie Gray). It would have been honest to set people's expectations accordingly.

It's the world of cellular phones and auto correct. It's hardly worth the time trying to fight it by going and correcting it until it keeps as the tiny keyboards are already pain enough to use.

I also understand that you only said something because it doesn't fit your idea. That's fine. Just be sure you know you are not attacking your own side because you are too dense to follow a conversation.
