The fundraising fell short (despite being one of the biggest funds collected), then the idiot who started the campaign couldn't actually do anything with the money he got, and finally GoFundMe just refunded everyone's money.

To be clear: they didn't find in favor of Sierra Club, this is just determining that the accusation/argument is different from another case so this one can move forward.

Don't get too excited. Trump will appeal to the 9th Circuit to rehear en banc. If they decline, and rehear and affirm the panel's decision, Trump will appeal it to SCOTUS. October is the earliest they'd hear it, and most likely Biden will be sworn in by the time a decision comes down.

Don't they have like two panels or something, and the third one fell over? All I can say is that every time he goes to visit his precious "wall" at a different spot the construction crew must get really tired of transporting those same two panels to each new location to be "inspected" by 45*

The latest twist in the legal battle that has largely gone Trump's way came after the Supreme Court previously allowed the $2.5 billion to be spent while the litigation continued, blunting the impact of the latest appeals court action.

The administration has already awarded much of the money, including a $1.3-billion job in Arizona that was announced last month. Trump visited Yuma, Arizona, this week to mark completion of the 200th mile of border wall during his administration, much of it with the transferred military funds that the 9th Circuit panel found illegal.

After the $2.5-billion transfer of military funds, the Pentagon diverted another $3.6 billion that an appeals court in New Orleans ruled in January could be spent.

The relief sought in the complaint is not only ceasing further funding, but ceasing any further building, regardless of whether funds have been dispersed.
