He should really understand that he doesn't have a constitutional right to operate a business open to the public.  It's why there are permits and occupational rules and stuff.

You don't have to prove it.

To prove negligence, all you have to show is a duty to act, a breach of that duty and then actual and proximate causation.

If the gyms breached their duty, or cannot show they took reasonable care to protect the patrons, then causation is easier to show. Was COVID present? Did the person have It? Then it was the gyms duty to prevent transmission.

I've seen online law-talking folks with their GED's in Law claim:

1. It's a takings clause issue. . .that the government is illegally taking their profits before they are earned by forcing them to shut down.

2. It's a due process issue. . .that they're being forced to close without being give a proper hearing where they can argue the importance of being able to stay open.

3. It's a Freedom of Assembly issue. . .that people are free to assemble however they wish and that includes giving patronage to stores at any time, including during a pandemic.

4. It' a 9th Amendment issue. . .that it's not explicitly spelled out in the Constitution, but there's an implied right to do business that the state is interfering with.

(Any of these arguments would be laughed out of court in a heartbeat)

. . .I always point out, in response, that SCOTUS ruled 118 years ago in Compagnie Francaise de Navigation a Vapeur v. Louisiana Board of Health, 186 U.S. 380 (1902) that states Constitutionally have broad police powers to protect public health, which can extend to involuntary quarantines, and that you don't have a right to due process to avoid a quarantine.  Constitutionally, the courts have consistently found that people collectively have a right to live, and that State Governments have a Compelling State Interest to protect the lives of people, which can extend to temporarily restricting individual liberties if the exercise of those liberties collectively places the lives of others at risk.

If, big if, they respond to that one, it's with some derp or warghabble about tyranny and communism and socialism and how they're free people and aren't going to do what the government tells them and that they know the Constitution better than the courts.
