When i was doing furniture delivery and they had an HOA gate, i'd just have my assistant walk around to the other side & trigger the motion detector that opens the gate.

Never needed a code for any of them.

No way in hell would I have waited an hour for the jackass to move his car.  I'd have called 911 myself and told them that if the police didn't move the guy out of my way, I'd be pushing his car out of the way with my delivery truck as an act of self defense.

I don't think blocking a vehicle actually qualifies as unlawful restraint in and of itself, as the driver could theoretically get out and walk away.  It's a dick move, certainly, but not necessarily criminal.

But I'm also not a law-talking guy. I failed my internet law school GED program after jacking it too many times to Judge Judy...

I have a friend that repairs spas and has to go into gated communities constantly.  He always gets harassed at the gates (even when he has the entry code) and when he is driving inside the community and he is white as can be.

Could just be that a lot of gated community residents fall into the Karen category.

Its actually illegal most places. For emergency vehicle access they must open freely.
Gates are there only to send a message. They are not and cannot legally be a barrier to entry.

OK, when I lived in a gated apartment complex, delivery drivers were able to call me from a keypad. I could open the gate myself. No code needed. Do they not work that way any more? As a side note, I live in a big HOA community, and yes, HOA's suck, but those common areas are a nice selling point...

Delivery driver here.  The van I've driven for the past 6 years at my job is completely unmarked.  No logo anywhere.  Only a small sign I put in the windshield that indicates I'm delivering flowers, be right back.  It is unmarked because many of the gated communities don't allow "commercial advertising" in their communities except during certain hours of the day.  And since I've delivered up until 8pm at times - no markings on the van let me get my job done.  Except Grandview - Grandview doesn't even allow trucks on their property after 4pm.  And why yes, that does include residents vehicles.  Not allowed to own a truck and live in that gated condo community.

Not once have I ever been blocked in and ordered to tell someone how I got the gate code.

This Miller guy is a crybaby.  I mean, all they did was hold him against huis will and keep him from doing his job.  It would have been fully within their rights to chase him down and shoot the unarmed driver three times in self defense.  What a wuss, not a single gunshot and he is complaining.  Heck, the HOA guy would have been justified in going back to Miller's house, breaking in, shooting his wife to death, then charging Miller with attempted murder.

Look, if you don't want to get hassled, you should try not being black.

You should hate to play "the other side."  There is no other side - here's the deal:  you think someone might be somewhere illegally or with nefarious intent, particularly in broad daylight?  Great, snap a few pics of the person and vehicle and report it to the police.  I suppose it's different if you think there's someone kidnapped in the back of a van and it's a matter of life and death, but a delivery truck leaving a gated community?  C'mon.  Seriously?  You think it's incumbent on the driver to do anything here?  Sure, he could have provided some info, but why should he have to?

Now the HOA guy could have NOT blocked him, but instead flagged him down and asked a question or two, and if the driver sped off, then call the cops.  Blocking a vehicle is IMMEDIATE escalation.  And after he blocks him in and gets challenged by the driver (rightly so), he spends an hour fake calling the cops?  If he had any reason to call the cops - any belief that this driver was there for illegal reasons - he would have called the cops in a second.  The fact that he didn't (or the possibility that he did and the cops told him to GFH), speaks volumes about his state of mind.  He didn't feel threatened or have a serious concern that something illegal was happening.  So what was he doing for an hour?  What was his motivation?  Maybe it wan't strictly racial - maybe he just stepped on his d!ck and was too proud to step off.  But that's not the driver's concern.  There is no other side here.

We tried calling Stewart. The only number we could find for him was disconnected.

We stopped by his house too, and no one came to the door.

Errr - good luck with that theory.  Gates can be a a legal barrier to entry in almost any situation - otherwise if you had a gate on the property you could not be legally barring entry at all at any time.  Which is chaotic stupid.  They're not usually a very practical barrier as there are many ways to circumvent them - but legally, sure - they're mobile wall pieces.

That being said, no HOA I've ever heard of actually has the legal authority to bar entry like this knucklehead tried to enforce, best they could do is make a trespassing call - but claiming gates aren't legal barriers of property demarcation (barring entry save to the authorized) is just plain wrong.

/TLDR: HOA guy's a dipshiat and at the absolute strongest should have made a trespassing call to the cops

But dont cry like a baby when you go out of your way to make a point.  All the delivery driver had to do was show a receipt and he would've been on his way in less than 5 minutes.  But he wasnt going to be disrespected like that and nobody's gonna tell him what to do, so here we are watching a video of where everyone is a douchebag.

Also, being that this is a gated community I bet the covenants even have something in there about visitors.

Shortly after a black man on a jog got gunned down by white guys in a vehicle in Georgia, a black man calls police about a confrontation in OK.  They never came to his assistance.

He even calls 911 back when the HOA guys moves his car because he doesnt want to get in trouble for leaving the scene. Just in case they were curious what happened since they didn't bother to send someone to check.  Was there a sudden crime wave in OK City that day?  Sick.

Cars in most states are viewed the same as a person's home. Meaning it is as legal to defend yourself in your car as it is in your home.

If the HOA people were that concerned, they would have called the police ASAP and would not have continously walked up to the driver's door.

As far as the driver, he is responsible for that truck and the merchandise on the truck so no, getting out and walking was not an option. I won't mention how leaving the safety of the truck when out numbered by hostile people isn't wise.

The driver should have been on the phone with 911 once the second guy showed up. He should have told them he was in fear of his life, the 2 men could be armed, they keep walking to their car and back to him, etc. Create the biggest fiasco as possible.

I used to rehearse with a band in Haymarket, VA 20 years ago in a gated community. Once a week I would roll up to the guard and each week he would ask my name and each time I would give him a new name.

Sure, I went through all them...

Al Coholic, Ben Dover, Hayward Jablowme, etc

He never caught on and this went on for two years!

Oh fark the fark off.  There is nothing the delivery driver needed to do here, and you have no idea what his motivation was.  For all you know he was delivering BDSM furniture or grow room hardware or a safe or any other thing where discretion is required.  Maybe his work has a don't give out info policy.  You do not know.  Besides, if he's not required to provide anything, he's not required to provide anything.  That's it - the whole story right there.

Now the HOA guy OTOH, his actions are suspect.  He didn't wave at the driver and try to flag him down for a quick question.  He blocked him in.  Then he fake called the cops for an hour.  If he had any reason to be concerned or suspicious, why didn't he "real call" the cops?  Why keep the delivery driver blocked in for an hour under those circumstances?

And even if the HOA has covenants on visitors or deliveries, those covenants have nothing to do with the driver.  He doesn't live there (presumably), he didn't sign the covenants.  What does their existence or non-existence have to do with anything that happened here.

Look, sometimes one party is in the wrong, and while the other party can diffuse the situation caused by the first party's wrongness, they don't have to and shouldn't be expected to.  You act like a d!ck, it's not on me to diffuse the situation you create.  I can if I like, but I'm not being a douchebag if I chose to let your d!ckishness play out.
