I presume under some statute granting emergency powers. That's how Governor Newsome of California is essentially running everything by executive orders, completely bypassing the state legislature. Of course there's always the chance that some of it IS illegal, but it'll be a long while until courts get to weigh in on that, and by then it'll be over.

Cuomo made the purchase on the White House's advice. Kushner was probably behind the advice. In which case, it wasn't emergency powers granted by legislation.
