Public beach in Florida is the beach from the water to the mean high water mark, and that has been the standard for more than 100 years. Keeping people off the part of the beach they own as residential property (the part from the mean high water mark [mean high tide line]) is an unlawful taking. There really isn't any way around that, the order today is wrong. Clearly their attorneys will appeal that.

It would be like saying you can't go in your front yard because a sidewalk goes through it.

They have to remind us that despite a global pandemic, they're still masters of the universe and trash like us can't understand the tremendous pressure of having so much money and power thrust upon us by god. They have to fight the evil government for access to THEIR private beaches while scum like us don't have the burden of property and money.

I can get a nice razor edge on almost any large metal blade. Good, quick, efficient guillotines are going to be needed to separate some people's minds from their wallets if this country misses three days worth of food in a row.

Sorry, but this isn't a taking under the constitution.  Also, Huckabee is only using corona as a ruse.  He has been trying to assert ownership all the way down to the water.

I believe they were assuming California's beach laws were universal. Beach property / access laws are different in every state.

What do you care? Shouldn't you be coughing on Mexican citizens and spreading pestilence in a different country by now? Certain rights get put on hold whether we like it or not -- Patriot Act (still a bullshiat series of laws), martial law, and now we're wading into new territory with a particularly insidious virus that's really good at hiding until it's too late to do anything about.

It is the beach from the mean high water mark to the water that is closed. It is a long-standing conflict that has beachfront owners in the Panhandle putting up no trespassing signs and using armed guards to prevent people from using the public beach behind their properties.
Mr. Huckabee and the other beachfront owners would like to use this pandemic to get an order giving them exclusive use to the public beaches that are guaranteed to the public under the Florida Constitution.

They are welcome to sit in their backyards but when they go onto the public beach that was ordered closed they are breaking the law.

I have been waiting for someone to "Stand Their Ground" and shoot one of the landowners or one of their armed thugs attempting to order them off the public beach.

I lived in DeFuniak Springs and often went down to Ed Walline beach access and walked down the beach to where an old tugboat was sunk about 50 yards out and spear fished. One day my son in law and I were walking across when an irate homeowner came running out threatening us for being on "his" beach. I was carrying my spear with the rubber hooked between my thumb and forefinger as was my habit when in the water. When he started screaming I slid my hand along the shank of the spear and just stood there until he stormed off to "report us for trespassing". My S-I-L said he thought for a minute I was going to shoot him. I just laughed and said just being prepared.

First of all, any entitled asshole who complains about their 20-room oceanfront mansion being a "confined space" can go and fark themselves. There are plenty of people sitting out the emergency in studio apartments.

Second, anyone who uses "recreate" as a verb connoting recreation isn't to be trusted.

DING DING DING, we have a winner! Huck and company have been trying to argue, for quite some time now, that public beaches are their private property, going so far as to out up no trespassing signs and hiring private security to remove people from land owned by the public. There are clear property lines for these people on public record, they're just trying to use this court order to get ANY court to give them legal standing of ownership for the public part.

Nobody is keeping these people from standing in the hundred feet that is their backyard, just keeping them from using the hundred feet that belongs to the public which is closed right now.
