I was a good young student, and teachers are often wrong.  I only pointed out when they were making an important mistake.

In the early 80s the US toyed with converting to the Metric system.  Damn them for not.  Anyway, our teacher was introducing us to kilometers.  She explained how long was in relation to a mile.  Then she showed a map.

These two cities, she said, were something like 300 miles apart.  Fine.  Then, she told us that they were something like 217 kilometers apart.  I don't remember the numbers, but you see the problem.

It struck me that she was giving out class a fundamental misunderstanding about kilometers, so I called her on it.

Me:  Miles are longer than kilometers.
Her:  Yes, that's right.
Me:  Then they'd have to be more kilometers apart than miles, not less.
Her:  Maybe they went by a different route.

It is weird, but people act in strange ways when under stress and coping with things that happened to them.

Could be an indicator that she's an evil harpy that's out to punish this boy because he's actually interested in another girl, or it could be a coping mechanism that helped her through her testimony.

I have a male child that was labeled a child predator in second grade.  It took the actual predator being caught to get the facts out.  And still, it took another round of lawyers slapping heads to get the written records corrected and the need for constant adult supervision.

He was always in the lowest percentile for height and weight, with very limited verbal skills.  All this combined made him an easy target for bullies, which the school understood, but only male ones.  They absolutely were certain that he was acting out sexually in school because of abuse elsewhere.

Yes, there was a sexually acting out cry for help, but it wasn't from my kid.  It was perpetrated on him.  And just like this story today, the school tried to kick him out.  It would not surprise me at all to find out the victim in this case has special needs as well.

Possibly. People have all kinds of weird reactions during and after a traumatic incident. It's not always dramatic tears and sobbing and hysterics like in the movies.

If this were the first or even the thousand and first time you might have a point. But it's completely farking predictable. The sexual assault reporting process is designed to protect The Boy and punish the girl. When I worked in the field it was down to a numbing routine.

The school can't comment on the other student's disciplinary action, but if you read between the lines it's plain what happened. The girl didn't want to go to the alternative school because the boy was there now (instead of the high school).

This happened to my sister in Mitchell County, Georgia in 2001. She was 14 years old. The boy who raped her was 18, and on the football team. Yes, this dumbass school district thought it was perfectly kosher to put eighth graders in high school.

She reported the assault to a teacher who told her to go home and take a shower and not to tell anyone. But she wasn't stupid and she called me. I picked her up and took her to the ER.

Even with that, the police refused to arrest him. "You don't want to ruin his life, honey. He comes from such a good family. He has such good grades. You wouldn't want to ruin his life over a simple misunderstanding, would you?"

Meanwhile, the SANE exam documented vaginal tearing, external and internal bruising of the vulva and vaginal canal, and bruises on her wrists, a black eye, and finger print bruising where he choked her.

And then they expelled her from school because she wouldn't sit in the lunchroom with a violent sexual sadist and pretend nothing happened.

Georgia needs to burn.

It occurs to me that the article specifies the boy didn't testify during the hearing, which would explain why the Principal would say "it was a birthday gift" as "J" likely had to explain his side at some point, just not during the part of the whole debacle that resulted in her being expelled.

Yeah, the article is very lazily and poorly written. You kind of have to pay attention and piece things together to get the picture.


Basically this is what seems to have happened according to the article:
○ Girl makes out with boy
○ Boy allegedly forces/coerces by grabbing her neck so she falls (?) girl to 'briefly' perform oral in school hallway
○ Girl goes to counselor and giggles while describing the assault
○ Counselor takes it to admins, presumes girl did it consensually due to her demeanor
○ Faculty reviews video, sees nothing, speaks to both Boy and Girl
○ Assistant Principal told it was a 'birthday gift' by boy (girl never said anything about birthday)
○ Girl ends up suspended pending a hearing
○ Boy not included in hearing, and ostensibly had no repercussions
○ Hearing happens, girl gets expelled for giving boy a b-day blowjob in the hallway

What's unclear is the timeline of when this all happened. Did she go right away, or did she wait a day, a week, a month...?

Also, if there was indeed a zero tolerance policy as the victim's lawyer suggests, then why is there no mention of suspension for the boy? He's clearly involved, and a zero tolerance policy should punish him as well, whether or not the assault allegation is factual.

I'd like to know the timeline of when the assault took place and when it was reported. While people falsifying sexual assault claims (which is basically what the school claims happened) is rare it does happen so we can't dismiss it outright as a possibility. But, if she went to her guidance counselor immediately after I'm more than inclined to believe her version of events (that's not to say I wouldn't believe her if she waited, but reporting it immediately raises fewer questions).

On the other hand, if we believe "J"s version of events, which the school clearly does, then he too should be suspended because he also engaged in sexual activity at school.

Also, why aren't the police investigating this stuff? Investigating sexual assault seems to be a little out of your average school administrator's league.

Schools, including universities, have no business in the criminal justice game. Let the real justice system sort it out, instead of just railroading every single person who is accused of something.
