Well, clearly not the customer driving the scooter because, let's face it -- this person is shopping at Wal-Mart and in a scooter. There's literally a snowball's chance in hell that there's money to be made there. Best bet would be Wal-Mart itself, followed closely by the scooter manufacturer. If those don't pan out then something more creative might be necessary. Perhaps the scooter driver was distracted by a cellphone or something and the cellphone company could be sued? Someone's responsible, though, that much is for sure.

We should also be looking at the use of 'who' when the correct form would be 'whom'.

The manufacturer of the floor polish.  WM can afford lots of good lawyers/stall forever while running up billable hours.  The polish people however ... their product made the floor so slippery that, even with emergency braking measures by the scooter rider, the scooter crashed into the woman.  Obviously it's their fault...

That's why I shop at Wal-Mart.  If I'm involved in any sort of incident or altercation (and the odds are petty high) people will assume I am one of the poors and not try to sue me.
/ The Dollar Store-worthy outfit I wear is another layer of protection.

If you are going through the whole process, why just sue for a 'reasonable amount' to be decided by a jury?
fark, go for broke and end up getting less, but if they decide a 'reasonable amount' is 12 bucks, you're screwed.

You always sue every single person/business that you can and let the court figure it out.  Waivers and even signs that say "operator assumes all risk" are rarely enforceable.

What if it is one of the Walmart provided scooters?  What is Wal Marts Liability.

The VA gave my dad a scooter and they made him take classes on it before they released it to him.

I hope she wins a huge amount of money. So much money that Walmart and other retailers decide it's too much of a liability risk to make motorized scooters available in stores and removes them all. That would be sweet.

I'd start with Walmart, then the Scooter company, then the company that made the paint for the scooter, the battery manufacturer of the scooter. Then Obama, the janitor that cleaned the Walmart, McDonalds because why not. Maybe Olive Garden then finally the customer's own parents since he/she/it didn't ask to be born only to be hit by a scooter.

Then get the heck out of the way!  I love the fat ashes that shop from the middle of the isle.  The scooters are  S L O W  can't you move?  My personal scooter can go 5.5 mph on the fastest setting, get out of my way!  Has a horn too and I use it.

Positive net worth? VERY unlikely. By the time you figure the 7 year 10% note on her 1996 Ford truck, the 30year note on her used single wide trailer and her back due medical bills, that woman would need tens of thousands more just to be worth Nothing.
