Here are two different ad concepts, let's see if either of your brain cells can analyze the implications:

Ben & Jerry: Hey shovel Chunky Monkey into your own fat pie hole, it will be great!

Remington: Use this semi-automatic rifle next time you're on a mission and really slaughter some mo-fos. It will be great!

I'm very critical of how we do guns in this country but this is BS. The product is not defective and the manufacturer has no way to stop people from misusing it. Put the responsibility where it belongs: on the murderer. Blaming the gun maker is just somebody looking for free cash.

If they advertised "hey go kill people with this thing!" surely you'd agree they'd fail in immunity defense. That's what the lawyers in Connecticut are saying, that their advertising practices encouraged exactly this behavior. It deserves to go to court on that basis.

Seems to me if people are so dumb they think Remington's marketing means they should go shoot people, we should be a LOT more worried about GTA or Rambo movie.

But we aren't. And that's because no one believes movies, video games or ads provoke shooters. The goal is not to force Remington to tone down their ads. It's to force Remington out of business.

I have one of the scary scary guns in question. At no point in time has it even entered my mind that I would 'slaughter some mo-fos' with it. At no point in time has it ever entered my mind to hurt anyone by any means I have available to me period. That's not how the thing is marketed.

A drunk driver hit my car.  I am going to sue Smirnov, Chevy, the county for building the roads and installing the traffic lights, the traffic light manufacturer, and Sylvania for manufacturing the lamps.  I am also suing the state for making the license allowing the drunk to drive, Dunlop for making the tires on both vehicles.

That's not really fair, unless you found a spoon manufacturer advertising specifically to a demographic on the edge of fattening themselves if presented this other type of spoon.

The Protection in Lawful Commerce in Arms Act might be applicable here, though I guess the CT Supreme Court didn't think so.

The sad part is that the further the courts let this go the bigger the legal costs that will eventually be awarded the defendants against the plaintiffs.

Didn't we just do this thread?

Anyway, the judge issued a narrow ruling allowing a suit to proceed on very specific grounds if they can find specific evidence that the manufacturer was basically encouraging illegal usage of their product.

Ultimately they're unlikely to be able to find such evidence and I don't think the suit will be successful for anyone but the lawyers charging for hours.

Well, thank Gawd only the most rational, well educated and unbiased of us are here on Fark to discuss the merits of gun ownership and this law suit in particular.

I am sure, after a brief but well reasoned and polite debate, we will come to resolution all Americans can agree upon.

He stole the gun from his mother and murdered her. Lanza didn't buy it as a result of any advertising campaign. He stole it from his mother after murdering her.

Well, the article makes a good point... he did not buy his rifle from Remington based on their ads. He MURDERED HIS MOTHER and took her gun, which apparently was a Remington.

I know the parents of the tragedy will never find peace. Even if they BBQ the murderer slowly over several days. I don't think this lawsuit does anything but prolong their pain and prevent them from moving on from the anger. They have every right to be angry, upset and sad, but it really sounds like greedy lawyers are steering this one.

Connecticut has zero standing to overturn federal law. The lower court was right and their supreme court is going to have the state paying a lot of money to Remington for malicious prosecution.

I'm heavily in favor of gun manufacturers paying into state governments funds to take care of issues around the killed and wounded like we did tobacco companies.
