To be fair, she wasn't speeding, wasn't under the influence, it may have been dark and the pedestrians she hit were crossing somewhere that had no pedestrian safety measures. I'm willing to believe this was a tragic accident for which jail might not be an appropriate punishment.

This is the Human Frogger problem...

We have a street where the bus stop is on one side of the road and the apartment complex where a lot of bus riders live is on the other, with a long walk to a stop light/crosswalk...or a short walk straight across.

So as you drive home in twilight, you pray they wear reflective clothing or are REALLY good at Human Frogger.

That and she was only ever charged with a misdemeanor, so significant jail time wasn't on the table to begin with.

She was not speeding.  She was not under the influence.  They were crossing in the evening not at a controlled crossing place.  She didn't see them.

It was an accident.  Pure and simple.  Unfortunate shiat happens sometimes and we shouldn't jail people for something that could happen to anyone.

And it was fark you Subby for being another ducked trying to inject racism into EVERY GOD DAMNED THING.

I'd have been very tempted to take my chances with a not guilty plea. It sounds like the entire case against her was "a baby died and so did the person who got the baby killed, so since we need to punish someone..."

If I read the story right, the city didn't charge her until the family sued the city. Sounds like the victims were partially liable for the accident. Why would she even plead with the facts from the story. In China, they would have roll back over the victims to make sure they were dead.

I can't say I know the details since I'm not going to click a Fox news link for any reason, but based on some of the comments in the thread, it sounds like a situation I'm familiar with. Down the street from the last apartment I lived at, there was another complex where the people who lived there would just go straight across the street from there, despite there being a traffic light not 30 yards away. And I remember thinking, more than once after driving home at night and slamming on my brakes once again because one of those idiots decided to wear all black and jaywalk that someday someone is going to run one of them over, and I'm going to feel sorry for the driver, not them.

Albeit it's never actually used that way, prison is supposed to be rehabilitation.

Based on the article it doesn't appear that she can be rehabilitated because it doesn't seem like she did anything wrong and it was a freak accident.

Assuming she didn't actually do anything wrong (texting, sleeping, whatever), then the city and the people hit could be just as much or even wholly to blame, or no one at all.

Sometimes shiat happens.

In other sources, it said that she was texting a father two minutes before the incident. How much are you willing to bet she was reading his answer at the time of accident ?

I'd bet that if the prosecution could prove phone use contributed to the accident, it would have made the news. "Texting teen kills baby" is media gold.

This is fark so maybe someone experienced will pull through and settle this. Which is worse, the pain of losing a child or the guilt of killing someone's child?

Actually I am.  My SO for many years was a black woman.  I got to experience racism directly through her interactions with the world and there is plenty of real racism in the world.  The false cries and people who support them because it "supports the cause" particularly piss me off because it dilutes the experiences of real people.  As it should everyone.

It's just too exhausting to be pissed off about it all the time though, so the alternative is to focus on those that impact you directly.  Which for the vast majority of people is "none", which means their reaction is "meh".  It's not apathy, it's a lack of context for hearing people cry wolf.

Yeah, it hit a nerve at theme wrong time.

A friend was a true victim of racism recently, contacted the Equal Opportunity commission.

The companies response to his racism claim was that "In today's environment, people are claiming racism any time the claimant is a minority, when there is no evidence that race played a factor..." Complain unfounded.

Now he is deciding whether to file a lawsuit anyway, but he is having a problem finding an attorney that will take the case.

Been in the shoes of the victim's family before, and I buried my grandfather in 2001 instead of getting the t-shirt.

This isn't a case about racism as the driver and victims were all the same race.  This is another one of those instances where a kid, a phone, a vehicle, and pedestrians mix into a tragic incident.  IMHO, the driver should have gotten some jail time from the beginning based on what investigators said unless they subsequently changed their statements.

Zoe Reardon faces eight misdemeanor charges that include vehicular homicide and the use of an electronic communication device under the age of 18 in connection with the Sept. 9 crash in Woodstock.

Reardon's attorney, Manny Arora, told Channel 2 his client texted her dad about dinner two minutes before the deadly accident. At the time, she was stopped in traffic elsewhere, he said.

However, investigators say Reardon "failed to exercise due care in operating a motor vehicle ... and engaged in the action of putting away her cellular telephone which distracted her," a point the teen disputes.

The young girl that killed my grandfather ran a red light and t-boned him in an intersection.  That caused him to lose control of his truck and end up in a drainage culvert.  The impact was forceful enough to bend the frame of his Ford Ranger into somewhat of a v shape.  She didn't get a citation for running the light much else anything else.  She walked away without even a slap on the wrist.

I'm not one to look for to find sympathy in car accidents, especially when there's a death involved.  I won't call it racism in either case as much as it is classism where some people matter more than others.

Why does the fact that she is a white female play into this? on the story it's incredibly odd that she was charged let alone took a plea deal.

Some people wearing dark clothes forcrossing the road at night she wasn't texting speeding under the influence of any substance and a terribly tragic accident happened.

It sounds like she needs to get a better lawyer, what does the person who submitted this thing should have happened? And do they really thinks it would be a vastly different outcome if the driver was somebody else?

- Prosecution will try to move the goalposts over to "imperfect" and claim if only she had been paying attention as she should've been, she would've had enough time to react
- No one likes to hear "shiat happens" when the shiat that happened was a dead baby

I actually started my career in journalism.  Yes, they are very similar.  Back then it was the newspapers saying "Hey look at this!".  Now it's people saying "Hey look at me!" through social media.  The major outlets are just a multiplier.

A friend of mine was charged with manslaughter for being in a crash that killed an adult woman and her elderly mother. Neither of which had their seatbelts on and had just passed 3 other cars and was travelling at least 15 mph over the posted limit. Gia crime was that as he topped the hill and saw the ladies car in his lane he panicked and swerved to miss them. He swerved across their lane instead of off his side which just happen to be swamp. 10 years probation and 2 felonies for the rest of his life. My argument was that had she not been passing going uphill in a double yellow he never would've swerved and the wreck would've never happened.
