They can use it, but they can't claim a patent of their own based on it. A patent allows the patent holder to prevent others from using the invention for a period of time. If Adam doesn't have the patent, he can't stop Honda from using the invention.

But in order to get a patent, the applicant has to show that the invention is "novel" -- that is, new. If Adam (or anyone else interested) can show that Adam had been using a version of the invention before Honda claimed it (a concept known as "prior art"), Honda's patent application will be denied or any patent that was issued will be invalidated.

The headline screwed up. His point was that he did the work for HONDA, but FORD is trying to patent it.

If they hired him to create something like this, and he did so while working for them, then he is probably SOL. If he was working for them not on a "work for hire" basis, created this without being prompted to, went to them with it and said "What do you guys think of this?", the contract ran out, *then* Honda filed their patent request without giving him credit, *then* he has a possible case.

Doesn't matter. The headline is wrong. Adam made this for Honda, then a year later Ford patented it.

Honda could patent it (he did the work for Honda, so Honda will own the rights), Ford stole the idea and did patent it but his prior art for Honda says it should be invalidated.

OK, Ford is borked, then. Not only does Adam have a possible patent case against Ford, Honda might have a theft of trade secrets case against Ford.

Except it is Ford doing the patent, not Honda doing so.  So that is a completely separate issue.  I will defer to the Fark Patent Bar for an in depth discussion on the ins and outs.

It's free to steal, but not get a patent on.

Also, while the idea might be the same, looking at the Adam Savage video his build was a giant box that sits ON TOP of the sidewalls in the back of the truck with the back of the projection on two prongs that go into the box.

The patent specifically states that the bottom section is an inverted T with the two projections going INTO openings IN the sidewalls.  Then the back of the projection is a standard T that is placed into the inverted one.

So completely different structure for the same function, kinda how patents work.

For reference, here is claim 1:

An entertainment support system attached to a pickup truck having a plurality of receptacles in sidewalls of a truck box spaced above a truck bed, comprising:
a mount including a T-member comprising a support for supporting a display device, and
an inverted T-member having a vertical arm disposed in slidable engagement with the T-member, and

Having to show that a patent application is for something 'new' may be how it's supposed to work.

But the US Patent and Trademark Office has a long history of issuing patents that should *never* have been granted.

a) see my post above, the structures are completely different from what was seen in the Tested video.  And the claims are what matter, which is entirely the structure of the device, not the title of the farking invention.

b) Examiner's are not omnipotent nor given the time to watch every single video on the internet.

God I hate our patent system. Nothing in this hasn't already been done before. Nothing is unique it's just a cross bar to mount a projector, speakers, and screen.

Just because it performs the same function doesn't mean that the structure isn't unique.  That hitch theater doesn't get inserted into the sidewalls of the truck and so wouldn't qualify as prior art.

Um, Adam, Ford doesn't have to have filed the patent before you did the work for the patent to be valid. They just have to have documented that they did the work before you did the work.

You've been to the Nashville live shows? Awesome!  He usually shows up occasionally at SF Sketchfest to do a short with them.

I know a guy here who was paid to do some design work on a feature for Chrysler.  When the work was done, he tried selling the design to a competing car company.
