This article doesn't go into all of the details of the incident with my son, and we already have the ACLU involved and a DOE Office of Civil Rights complaint filed. I drug and nicotine tested Evan the day of and day after the incident and he came back clean, I tried to show the school director the test results in Evan's disciplinary meeting but he didn't even care. Evan was the first male cheerleader on the squad and what we found was that some of the school administrators did not like him out there cheering for their football team so they did what they had to do to get rid of him. This really hit him hard as he bonded with a lot of the team and really felt included and that was taken from him. We are pursuing other legal action as well but it would be great to see some "not snark" support (of maybe a little since this is Fark) from the internets for him.

Something they don't go into in the story also is the head cheerleader did get caught with a vape pen, told the school it was Evan's and they let her off scott free. She even said she had 2 vape pens she just "kept in her backpack" but didn't use and named another boy, a baseball player, as the owner of another pen but he wasn't disciplined at all either. She then told the other cheerleaders if they stepped out of line she would get them kicked off the team like Evan. Just a messed up situation all around.

Aside from how messed up the story is itself, 8 days suspension???  Even if he HAD been vaping, that is outrageous in and of itself.

Hope you get some justice.  I think you are taking the right routes.....Hopefully Fark is nice to you, but I could see a thread like this go a couple different ways.

Ok, after skimming the story I feel bad about the snark.

If everything in the story is true, it certainly sounds like your son is unfairly bearing the brunt of disciplinary action.

That aside, strip searching a minor is totally inappropriate and completely unacceptable.

I hope you sue them into oblivion.

Seriously...  It's not like vaping is some sort of a performance enhancing drug that magically makes you a better cheerleader.  So what the hell are they being so strict for?  Because those are the rules?!

Well then it's time for new rules.
No one should have their life ruined because of a silly archaic rule involving conduct in an extra curricular activity.

Oh we did, there is an investigation ongoing with Maricopa Sherriff's Office, we filed that complaint the day after this happened.

Arizona's charter schools are primarily run by private companies. They must have a governing board, but school owners get to pick who's on the board, so many are stocked with relatives, friends and even the charter's owner. In some instances, boards have just one member - the charter operator.

This sounds like a conservative wonderland to me. No pesky government interference and everyone close to the boss gets to wet their beak.

Sorry about your kid's tough break though.

Smoking isn't legal at 16 so I can see why vaping would also be banned.

Nicotine vaping. Not Cannabis vaping. Pretty sure nicotine vaping is legal in AZ, but probably not for high school kids, depending on age. Regardless, it's a charter school, so they can just set their own regulations around that.

That being said, this shiat is nonsense. I'd make a snarky remark about escaping the Phoenix area after 16 years, but I escaped to Texas..

So when Evan gave his statement the day after to the sherriffs department he did it for them on camera, that time it was crazy huge how much "smoke" came out. We filed to get that video as well. It ain't like it's ever really cold out here, he hears up the vapor and does it.

No, you just compress the air in your mouth and lungs, and then exhale some visible vapor. Kid's pretty good if he can make it look like he has a vape pen!

Possible defense: your kid gets another kid to testify that he's sexually active. Everyone knows that vapers don't get laid.

There are vaping substances out there that have zero nicotine in them.  Just some sort of base oil, and flavoring. People use them to do "smoke" tricks.
