With all the calls for doxxing, I'm pretty sure we would have heard of anything like that from the kids already, but we will find out.

The lawsuit claims that the Post "wrongfully targeted and bullied Nicholas because he was the white, Catholic student wearing a red 'Make America Great Again' souvenir cap on a school field trip to the January 18 March for Life in Washington, D.C."
The complaint also accuses the Post of engaging in a "modern-day form of McCarthyism by competing with CNN and NBC, among others, to claim leadership of a mainstream and social media mob of bullies which attacked, vilified, and threatened Nicholas Sandmann, an innocent secondary school child."

That lays it on pretty thick with the sweet innocent child bit. Usually a bad sign when someone works so hard at trying to claim exulted moral high ground as it suggests it's a lawsuit founded more on moral indignation than a robust legal case. But neither his innate virtue or vice will matter at all. His social media history won't matter, and neither will videos of his classmates in blackface or chanting. The question seems to simply be did Wapo paint him as a racist or otherwise make a point of bullying him with specific attention the natural newsworthiness of the story.

That's last bit is going to be incredibly difficult as "it went viral" and thus had a life of its own independent of anything WaPo did. The solid question is in what way the kid's lawyers are going to claim that WaPo painted him as a racist.

I think most people first saw it on Twitter. It wasn't WaPo that had a monopoly on this story nor did they first break it. IIRC, even the Fark link was to some random guy's Twitter. That's even where the doxing happened.

I have a feeling it's not about the damages or even the potential settlement.  They're going to set up a gofundme for a legal fund to fleece that deep well of conservative stigginit.

They could have let this go and in a week or two or three it would have mostly been forgotten. The videos of MAGA-hat Boy won't go away anytime soon or ever, of course, but in the grand sweep of American life, fewer and fewer people would have even remembered that this happened.

I wonder what the actual impetus for this was? Someone get a highly discouraging verbal response from a Harvard trustee, do you think? Someone's parents getting the side-eye when they're out for dinner at Summit Hills? Someone suddenly find that the sexiest young women don't, in fact, prefer packs of entitled little douchebros?

There's nothing defamatory in the Post's coverage of this incident to date. And Little Nicky Trollface, there - right along with his family, some of his classmates, their attorneys and whichever Trumpustule farkstick in or out or merely aligned with this increasing clusterfark of an administration put them up to it (the overwrought language in the complaint is a dead farking giveaway) - are going to discover that Mrs. Graham's legacy (and Jeff Bezos' attorneys) are all still very much alive and kicking hard.

Now if you'll excuse me, it's my week for the snacks and I have about twelve metric tons of popcorn to prepare.

No, he doesn't have to establish that he isn't a racist. Why would you even entertain such a foolish idea?
What he has to establish is that WaPo was malicious and/or reckless in how they portrayed him in an unfairly negative manner. Further, even if there exists secondary information about the kids negative qualities from other times and places, WaPo will need to justify their specific coverage of him at that specific event.

The way this may break down will be that the kid's lawyers will try to look at how WaPo made a point of the kid wearing a MAGA hat. WaPo's defense will be that he was wearing a MAGA hat. The kid's lawyers will say but you implied that wearing the hat meant he was racist. Then WaPo will have to show that they did not invent or especially promote that interpretation, they just reported that wearing the hat has implications to some witnesses. Then there will be back and forth about who is responsible for those implications and accusations that WaPo is irresponsible for perpetuating such stories but that line will just make the judge shake her head and eventually ask the plaintiff's lawyers if they have anything more substantial or would they like her to rule now? But I may be drifting off into dreamland.

His goal isn't to win a $250M lawsuit. His goal is to get on the right-wing grift train.

He's hoping to whip up a bunch of friendly press by simultaneously playing the two most beloved right-wing-grifter roles of "poor victim of PC oppression" and "devastating champion of lib-owning MAGA glory." His family will then be able to monetise that press with some paid appearances, then "provocative" speaking gigs (hopefully letting him complain on national TV about being "silenced" because a handful of college freshmen protest at one of those gigs), then a book deal, maybe a regular gig on NRA TV, and before you know it he's got himself an easy mid-six-figure job tweeting some lazy "Dems are the real racists" nonsense every couple hours, and every couple evenings going on a panel show to yell the same thing all the other MAGA chuds are yelling that day.

His family knows he hasn't got a prayer of winning a dime in court, but he isn't actually going to go to court any more than any right-wing grifter has with their threats of frivolous lawsuits, including D2S* himself. He's climbing about the Easy Money Express.

*Milo, if you can remember him, is the only grifter I can remember who actually went to court, and got absolutely demolished.
