I could be wrong, but I'm pretty certain that castle doctrine/stand your ground doesn't allow you to follow the person you think was trying to break into your home to someone else's property and pull a gun on them.

Times have changed.  Heck, if the boy scout had been any color other than white, the Fire Chief could have followed the kid home and shot him in his own bed.

I was canvassing for the ACLU for the 2018 election and had a gun pulled on me. Nice neighborhood, 3:30 in the afternoon. I told him "I'm not a threat, just out trying to get the vote out " ...dudes like that are pitiful

Do we know he was white? The responsible gun owner's behavior suggests otherwise.

A penis so miniscule that owing a truck thats been lifted 2 feet beyond factory specs, tuned to belch black smoke, and stickers of Calvin pissing on things isn't enough compensation.  You gotta chase a boy scout, with a firearm to prove you are a man.

Hey TL Lawyers.

Is there or isn't there a common law principle that if you have a unbarred walk leading from public property to your front door, that you've in effect granted an easement for anyone to walk up to your door?

I did some canvassing for the 2000 census and I had one guy threaten to kill me if I ever came back to his house.

Well, you're wrong-ish.

Castle doctrine has nothing to do with it.  Citizen's arrest for a felony does, and attempted burglary of an occupied dwelling is typically a felony.  So you can in fact follow a person who was trying to break into your house.  Stand your ground applies if, upon catching up to that person, you have a reasonable fear for your life.

Of course, none of that matters if you're actually following someone who was putting a food drive flyer on your house.  That's why a citizen's arrest is frequently a bad idea, you have full liability if you are wrong about a crime having been committed.

FTA: Kutz, who is also a captain with the Allentown Fire Department, was charged on Jan. 11 with simple assault and harassment. He was arraigned by District Judge Jacob Hammond and released on $25,000 unsecured bail.

Simple assault? Fark, you pull a gun on anyone in Florida, it's aggravated assault, a felony.

His name is James R. Kutz. We should keep it kinda quiet, we don't want James R. Kutz to get a bad reputation. James R. Kutz shouldn't have his name on the internet in a derogatory fashion. James R. Kutz,

For attempted burglary you can make a citizen's arrest.

You know what would be helpful with all these newspapers? If they listed somewhere on the page what farking state they're in. There's a farking Whitehall in several states. I'd like to know if it's my state's Whitehall, or some other state's Whitehall.

Would it hurt these news sites to just put a line under their title that includes the state? Is that asking too much from journalists these days?!

If, at the age of 39 and physically hale enough to serve as a fire fighter, you need a handgun to deal with a 12yo you are a complete failure as a human being and should consider suicide not only for the betterment of the species but for the relief it would no doubt provide to everyone who knows you.

so 12 year olds have never attempted to break into a house before? ever?

This dude overreacted. It sounds like it was after dark, if someone was at my front door and my wife saw them then they ran away I would also attempt to find out what they were up to.

Not a hard one to figure out. The Boy Scout is a kid who's been forced to do something by adults.

Well first, the kid must be attempting burglary.

I don't think burglars go around in a safety reflective vest, Scout uniform, and a headlamp, with food drive flyers as their burglary tools.

There method of determining that a burglary was being commited was they heard a noise from the storm door. By their standards, UPS, FedEx, the pizza delivery guy, and anyone coming to their house for a visit is breaking into their house. People this paranoid might not be the best suited to have gun ownership.
